In a criminal appeal to the Federal Supreme Court, the appellant withdrew the appeal by letter of 13 August 2009. The President of the Criminal Division therefore removed the case from the docket as moot and ordered that no costs be levied. The order was sent to the parties and to the Zurich High Court, Criminal Chamber.
Withdrawal of an appeal before the Federal Supreme Court; mootness and costs: if the appellant withdraws the appeal, the proceedings are struck from the docket as moot. In such a constellation, the court may waive the collection of costs. The dispositive consequences follow directly from the absence of a pending dispute; no substantive review of the challenged judgment takes place.

Diese Verfügung wird den Parteien und dem Obergericht des Kantons Zürich, II. Strafkammer, schriftlich mitgeteilt.
