Resumo Omnilex

The Federal Supreme Court did not enter into the appellant's criminal complaint against the cantonal prison reporting order. It held that, because the underlying decision was based on cantonal execution law, only constitutional violations or arbitrariness could be reviewed, and the appellant's submissions amounted only to inadmissible appellatory criticism. The request for suspensive effect became moot. The Court denied free legal aid because the complaint had no prospects of success and imposed a reduced court fee of CHF 500 on the appellant.

Sumário Omnilex

Art. 106 Abs. 2 BGG, Art. 108 BGG; requirements for complaints alleging constitutional violations against cantonal execution decisions. Where the challenged measure rests on cantonal law, the Federal Supreme Court examines only duly substantiated claims of fundamental-rights violations or arbitrariness. The appellant must identify the specific constitutional guarantee and explain, with reference to the impugned reasoning, why it was infringed; mere appellatory criticism is insufficient. If this substantiation threshold is not met, the complaint is not entered into under Art. 108 BGG. Hopeless proceedings also exclude legal aid under Art. 64 BGG; costs may be reduced in light of the party's financial circumstances under Art. 65 Abs. 2 BGG.

Urteil vom 18. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Amt für Justizvollzug des Kantons Zürich, Strafvollzugsdienst, Postfach, 8090 Zürich.

Gegenstand
Strafantritt,

Lausanne, 18. September 2007

Allocation of court costs.

Decisão extraída

Court costs were imposed on the appellant, reduced to reflect his financial situation.

Fundamentação extraída
