Resumo Omnilex

The Federal Supreme Court declined to enter into the criminal appeal because the appellant's submission did not comply with the reasoning requirements of Art. 42(2) BGG. His proportionality argument was unrelated to the actual conviction and sentence for repeated document forgery and repeated driving without a valid licence. The appellant was ordered to pay court costs of CHF 800.

Sumário Omnilex

Art. 42 Abs. 2 BGG; Art. 108 BGG; inadmissibility for insufficient reasoning in a criminal appeal. An appeal to the Federal Supreme Court must, in a reasoned manner, engage with the contested decision and show, by reference to the decisive considerations, why it is unlawful. Abstract or unrelated submissions do not satisfy the pleading requirement. Where this requirement is not met, the appeal may be disposed of in summary proceedings under Art. 108 BGG without examination of the merits. Court costs are ordinarily borne by the unsuccessful appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 19. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,

gegen

Generalprokurator des Kantons Bern, Postfach 7475, 3001 Bern.

Gegenstand

3.
Dieses Urteil wird dem Beschwerdeführer, dem Generalprokurator des Kantons Bern und dem Obergericht des Kantons Bern, 1. Strafkammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the criminal complaint met the Federal Supreme Court's reasoning requirements under Art. 42(2) BGG.

Decisão extraída

It did not. The appellant's proportionality argument was unrelated to the challenged conviction and sentence, so the complaint was insufficiently reasoned.

Fundamentação extraída

The submission did not address why the convictions or sentence were unlawful; therefore the appeal failed to satisfy the pleading requirements and could not be examined under Art. 108 BGG.

Questão jurídica principal

Allocation of court costs.

Decisão extraída

The court costs were imposed on the appellant.

Fundamentação extraída

As the complaint was not entered into, the costs follow the losing party.
