The Federal Court held that the appellant lacked standing to challenge the cantonal refusal to open criminal proceedings. Because the Staatsanwaltschaft had participated in the cantonal proceedings, he was not a private prosecutor under Art. 81(1)(b)(4) BGG. He was also not a victim within the meaning of Art. 81(1)(b)(5) BGG and Art. 1 OHG, since the alleged theft in connection with a house search did not immediately affect his personal integrity. The complaint was therefore not entered into under Art. 108 BGG. Court costs of CHF 800 were charged to him.

Where standing is absent, the Federal Court does not examine alleged defects in the underlying search or investigation and will not enter into the complaint in summary procedure.

Beschwerde gegen den Entscheid der Anklagekammer des Kantons St. Gallen vom 15. April 2009.

Der Präsident zieht in Erwägung:

Im Zusammenhang mit einer Hausdurchsuchung reichte der Beschwerdeführer gegen die beteiligten Personen eine Strafanzeige wegen Diebstahls ein. Die Beschwerde richtet sich dagegen, dass im angefochtenen Entscheid die Eröffnung eines Strafverfahrens abgelehnt wurde. Die Staatsanwaltschaft war indessen am kantonalen Verfahren beteiligt (s. Mitteilungssatz auf S. 5 des angefochtenen Entscheids), weshalb der Beschwerdeführer nicht Privatstrafkläger im Sinne von Art. 81 Abs. 1 lit. b Ziff. 4 BGG ist. Er wurde durch das angezeigte Verhalten auch nicht in seiner körperlichen, psychischen oder sexuellen Integrität unmittelbar beeinträchtigt, weshalb er nicht Opfer im Sinne von Art. 81 Abs. 1 lit. b Ziff. 5 BGG in Verbingung mit Art. 1 Abs. 1 OHG ist. Als Geschädigter, der nicht Opfer ist, ist er zur vorliegenden Beschwerde nicht legitimiert (BGE 133 IV 228). Unter diesen Umständen kann sich das Bundesgericht mit der in der Beschwerde aufgeworfenen Frage, ob die Hausdurchsuchung korrekt durchgeführt wurde, von vornherein nicht befassen. Auf die Beschwerde ist im Verfahren nach Art. 108 BGG nicht einzutreten.

Die Gerichtskosten sind dem Beschwerdeführer aufzuerlegen (Art. 66 Abs. 1 BGG).
Demnach erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.

2.
Die Gerichtskosten von Fr. 800.-- werden dem Beschwerdeführer auferlegt.

3.
Dieses Urteil wird den Parteien und der Anklagekammer des Kantons St. Gallen schriftlich mitgeteilt.
