Resumo Omnilex

The Federal Supreme Court held that the appellant’s complaint against the Schwyz Cantonal Court decision was late. The decision was deemed served after the seven-day postal collection period, and the appellant had not shown any valid reason excusing non-collection. Because he had already been involved in proceedings, he had to expect court mail and ensure service could be effected. The Court therefore refused to enter into the complaint under Art. 108 BGG, denied free legal aid due to lack of prospects of success, and ordered reduced court costs of CHF 500 against the appellant.

Sumário Omnilex

Art. 100 Abs. 1 BGG, Art. 108 BGG; postal service and culpable prevention of service: a judicial decision deposited for collection is deemed served upon expiry of the postal holding period. A party already engaged in proceedings must act according to good faith and take measures to ensure receipt of court mail. If the party omits to inform the court of an absence and thereby prevents delivery, service is considered culpably frustrated; the ensuing time limit runs from the deemed-service date. A complaint filed after expiry of that limit is not entered into. Free legal aid under Art. 64 BGG is unavailable where the appeal is manifestly devoid of prospects of success; court costs may be reduced under Art. 65 Abs. 2 BGG to reflect the party’s financial situation.

Urteil vom 5. Juni 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Schwyz, Postfach 1201, 6431 Schwyz,
Beschwerdegegnerin.

Gegenstand
Einsprache gegen Strafbefehl,

Beschwerde gegen den Beschluss des Kantonsgerichts Schwyz, Beschwerdekammer, vom 18. Februar 2014.

Der Präsident zieht in Erwägung:

1.

Der angefochtene Beschluss wurde am 21. Februar 2014 versandt und dem Beschwerdeführer am 22. Februar 2014 ins Postfach avisiert.

Whether the complaint to the Federal Supreme Court was filed within the statutory time limit

The complaint was out of time because the lower-court decision was deemed served after the seven-day postal pickup period and the filing deadline then expired on 31 March 2014.

Fundamentação extraída

A party who has already initiated proceedings must expect court mail and must ensure service can be effected. By failing to inform the court of an absence, the appellant culpably prevented service.

Questão jurídica principal

Whether the appellant qualified for free legal aid

Decisão extraída

The request for free legal aid was denied because the complaint had no prospects of success.

Fundamentação extraída

Since the complaint was manifestly late, the legal remedies sought were futile.

Questão jurídica principal

Allocation of court costs

Decisão extraída

Court costs were charged to the appellant, with his financial situation taken into account.

Fundamentação extraída

As the complaint was not entertained, costs were imposed on the losing party; reduced means were considered in fixing the amount.
