Resumo Omnilex

The Federal Supreme Court held that the criminal appeal against the Bern cantonal judgment was filed after the 30-day time limit, even accounting for the statutory suspension of deadlines. In addition, the filing did not meet the Federal Supreme Court's strict reasoning requirements, as it merely disputed the complainant's account without demonstrating manifest error or arbitrariness. The Court therefore refused to enter into the appeal in summary proceedings and charged the appellant CHF 800 in court costs.

Sumário Omnilex

Art. 100 Abs. 1, Art. 42 Abs. 2, Art. 106 Abs. 2, Art. 108 and Art. 66 Abs. 1 BGG; inadmissibility of a criminal appeal filed out of time and, in any event, insufficiently reasoned. The 30-day period for a Federal Supreme Court appeal runs from service of the full decision and is extended only by statutory deadline suspensions. An appeal that merely contrasts the appellant's own version of the facts with that adopted by the lower court, without showing manifest factual error or arbitrariness, fails the specific reasoning requirement. Where both inadmissibility grounds are apparent, non-entry in summary proceedings is proper; court costs are borne by the appellant.

Urteil vom 26. Mai 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Hochschulstrasse 17, 3012 Bern,
Beschwerdegegner.

Gegenstand
Üble Nachrede, Beschimpfung, Tätlichkeiten,

Beschwerde gegen das Urteil des Obergerichts des Kantons Bern, 2. Strafkammer, vom 7. November 2008.

Der Präsident zieht in Erwägung:

1.

Strafkammer, schriftlich mitgeteilt.

Lausanne, 26. Mai 2009

Questão jurídica principal

Whether the criminal appeal was filed within the statutory deadline under the Federal Supreme Court Act.

Decisão extraída

The appeal was filed late; the deadline expired on 2009-05-18, while the statement of reasons was posted on 2009-05-21.

Fundamentação extraída

The complete decision was served on 2009-04-03. Even taking the statutory suspension into account, the 30-day deadline had passed when the filing was mailed.

Questão jurídica principal

Whether the appeal satisfied the Federal Supreme Court's reasoning requirements despite the alleged serious illness of the appellant.

Decisão extraída

No. The submission did not meet the requirements of Art. 42(2) and Art. 106(2) BGG.

Fundamentação extraída

The mere assertion that the complainant's version of events differed from the prosecution witness's account did not show that reliance on the witness statements was manifestly incorrect or arbitrary.

Questão jurídica principal

Whether the appeal could be examined in summary non-entry proceedings under Art. 108 BGG.

Decisão extraída

No entry into the appeal was warranted.

Fundamentação extraída

Because the appeal was untimely and in any event insufficiently reasoned, summary non-entry was appropriate.
