Resumo Omnilex

The Federal Supreme Court did not enter into the complainant's filing against the cantonal confirmation of a discontinuance in a boundary-displacement investigation. It also did not entertain his recusal request, because prior participation in another case is not enough to establish bias. The Court held that the complainant lacked standing as an allegedly injured person and that the appeal was in any event inadequately reasoned. His request for free legal assistance was refused as hopeless, and the court fee of CHF 800 was charged to him.

Sumário Omnilex

Art. 34 Abs. 2 BGG; Art. 81 Abs. 1, 64, 66 Abs. 1, 106 Abs. 2, 47 Abs. 1 and 108 BGG; non-entry for lack of standing and insufficient reasoning, and recusal. Prior participation of a federal judge in an earlier proceeding does not, by itself, constitute a ground for recusal, even if the earlier matter was decided adversely to the party concerned (consid. 1). An alleged injured person has standing only if a legally protected interest in the annulment or modification of the challenged decision is shown; absent such interest, and where the submission remains appellatory and does not meet the federal reasoning requirements, the complaint is inadmissible. The statutory appeal period cannot be cured by subsequent supplementation. Free legal assistance is denied where the appeal lacks prospects of success; inability to pay must be asserted at least plausibly (consid. 2-3).

Urteil vom 16. August 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Wallis, Justizgebäude, av. Mathieu-Schiner 1, 1950 Sitten.

Gegenstand
Einstellungsverfügung (Verdacht auf Grenzverrückung),

Beschwerde in Strafsachen gegen das Urteil des Kantonsgerichts Wallis, Strafgerichtshof I, vom 13. Juni 2007.

Der Präsident zieht in Erwägung:
1.

5.
Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft des Kantons Wallis und dem Kantonsgericht Wallis, Strafgerichtshof I, schriftlich mitgeteilt.

Questão jurídica principal

Whether the request to recuse federal judges should be entertained

Decisão extraída

The recusal request was not entertained because prior participation in another case is not, by itself, a ground for recusal, even if the prior outcome was adverse.

Fundamentação extraída

The submission only pointed to possible bias and relied solely on earlier participation, which does not establish a disqualification ground.

Questão jurídica principal

Whether the complainant had standing to appeal the discontinuance order

Decisão extraída

The complainant lacked standing because, as an alleged injured party, he had no legally protected interest in overturning or changing the challenged decision.

Fundamentação extraída

He did not show a legally protected interest under the Federal Supreme Court Act.

Questão jurídica principal

Whether the appeal satisfied the Federal Supreme Court's reasoning requirements

Decisão extraída

The appeal was insufficiently reasoned and consisted largely of inadmissible appellate criticism.

Fundamentação extraída

The complaint did not meet the requirements for a constitutional or otherwise properly reasoned challenge, and no supplementary filing could cure this because the deadline is statutory.

Questão jurídica principal

Whether free legal assistance should be granted

Decisão extraída

Free legal assistance was denied because the requested claims had no prospects of success and indigence was not even alleged.

Fundamentação extraída

The application failed both on the merits and on the requirement of need.

Questão jurídica principal

How court costs should be allocated

Decisão extraída

Court costs were imposed on the complainant.

Fundamentação extraída

As the appeal was inadmissible and the legal aid request failed, the costs were charged to him.
