Resumo

The appellant withdrew his appeal against the 26 November 2008 judgment of the President of the Pretura penale. Acting as single judge, the President of the Criminal Law Court of the Federal Supreme Court ordered the case struck from the docket. Given the withdrawal, the Court waived the collection of court costs. The order was communicated to the parties and to the President of the Pretura penale.

Art. 32 cpv. 1 e 2 LTF; art. 66 cpv. 2 LTF: upon withdrawal of an appeal, the President or instructing judge may, as single judge, order the case struck from the docket and decide on costs. In the event of desistance, the Federal Supreme Court may waive court costs wholly or in part; such waiver is a matter of discretionary assessment in the individual case (consid. 1).

Infrazione alla LCStr,

ricorso in materia penale contro la sentenza emanata il 26 novembre 2008 dal Presidente della Pretura penale.

Considerando:
che con scritto del 14 gennaio 2009 A.________ dichiarava di ritirare il ricorso inoltrato contro la sentenza del 26 novembre 2008 del Presidente della Pretura penale;
che il presidente o il giudice dell'istruzione della Corte decide quale giudice unico circa lo stralcio dal ruolo delle cause ritirate (art. 32 cpv. 1 e 2 LTF) e, in tale ambito, statuisce sulle spese giudiziarie (art. 5 cpv. 2 PC in relazione con l'art. 71 LTF);
che, in caso di desistenza, il Tribunale federale può rinunciare in tutto o in parte a riscuotere le spese giudiziarie (art. 66 cpv. 2 LTF);
che nella fattispecie si può rinunciare a prelevare spese processuali;

per questi motivi, il presidente decreta:

La causa 6B_4/2009 è stralciata dai ruoli a seguito del ritiro del ricorso.

2.
Non si prelevano spese giudiziarie.

3.
Comunicazione alle parti e al Presidente della Pretura penale.
