Resumo Omnilex

X. appealed to the Federal Supreme Court against a Zurich High Court circulation decision that had ended the cantonal appeal proceedings as withdrawn because he failed to file and justify his appeal requests within the set time limit. The Federal Supreme Court held that the complaint was insufficiently reasoned, as it merely referred to an earlier submission without showing any violation of federal law or arbitrary application of cantonal criminal procedure. The court therefore did not enter into the complaint and ordered the appellant to pay court costs of CHF 800.

Sumário Omnilex

Art. 42 Abs. 2, Art. 95, Art. 106 Abs. 1 and Art. 108 BGG; requirements of reasoning for a complaint to the Federal Supreme Court. A federal complaint must, in a manner enabling review, set out why the challenged decision is alleged to violate federal law or, where cantonal law is invoked, why its application is arbitrary. Mere reference to earlier submissions or conclusory assertions does not satisfy the duty to state reasons. If the complaint manifestly lacks such substantiation, the Court may decline to enter into it in summary procedure under Art. 108 BGG; the costs are borne by the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 11. Juni 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Verletzung von Verkehrsregeln,

Beschwerde gegen den Zirkulationsbeschluss des Obergerichts des Kantons Zürich, I. Strafkammer, vom 24. Februar 2009.

Erwägungen:

1.
