Resumo Omnilex

Firma X. challenged the St. Gallen Anklagekammer’s decision upholding the non-entry on its criminal complaint for commercial copyright infringement. The Federal Supreme Court held that the company lacked standing: it was neither a private complainant within the meaning of the Federal Supreme Court Act nor a victim under the Victim Assistance Act, since the alleged offense did not directly affect its physical, psychological, or sexual integrity. The Court therefore did not enter into the appeal under Art. 108 BGG. The appellant’s request for interim access restrictions to the file became moot, and it was ordered to pay CHF 800 in court costs.

Sumário Omnilex

Art. 81 Abs. 1 lit. b Ziff. 4 and 5 BGG; Art. 1 Abs. 1 OHG; standing to appeal in criminal matters: an injured party that is neither private complainant nor victim lacks legitimacy to challenge a cantonal non-entry decision. Where the prosecution participated in the cantonal proceedings, private-complainant status is excluded; and victim status requires a direct impairment of bodily, psychological, or sexual integrity. An appeal filed without standing is not entered into under Art. 108 BGG. Ancillary procedural requests become moot once the appeal is disposed of. Court costs are imposed on the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 4. Mai 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
Firma X.________,
Beschwerdeführerin, vertreten durch Rechtsanwalt
Dr. Conrad Weinmann,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
Beschwerdegegnerin.

Gegenstand
