The Federal Supreme Court held that the complainant lacked standing to challenge the dismissal of a criminal investigation for neglect of maintenance obligations. Because the cantonal proceedings involved the public prosecutor, she was not a private prosecutor; and because non-payment of maintenance does not directly affect physical, psychological, or sexual integrity, she was not a victim under the Victim Assistance Act. The complaint was therefore not entered into under Art. 108 BGG. The request for free legal aid was denied as hopeless, and reduced court costs of CHF 500 were imposed on the complainant.

Beschwerde gegen den Entscheid des Obergerichts des Kantons Luzern, Kriminal- und Anklagekommission, vom 23. März 2009.

Der Präsident zieht in Erwägung:

Die Beschwerde richtet sich dagegen, dass der Amtsstatthalter von Luzern eine Strafuntersuchung gegen den Beschwerdegegner wegen Vernachlässigung von Unterhaltspflichten am 14. Januar 2009 einstellte und die Vorinstanz im angefochtenen Entscheid einen dagegen gerichteten Rekurs abwies. Die Beschwerdeführerin ist indessen nicht Privatstrafklägerin im Sinne von Art. 81 Abs. 1 lit. b Ziff. 4 BGG, weil die Staatsanwaltschaft am kantonalen Verfahren beteiligt war. Sie ist auch nicht Opfer im Sinne von Art. 81 Abs. 1 lit. b Ziff. 5 BGG, weil sie durch eine Vernachlässigung von Unterhaltspflichten nicht in ihrer körperlichen, psychischen oder sexuellen Integrität unmittelbar beeinträchtigt wird (Art. 1 Abs. 1 OHG). Als Geschädigte, die nicht Opfer im Sinne des OHG ist, ist sie nicht legitimiert, Beschwerde in Strafsachen zu erheben (BGE 133 IV 228). Auf die Beschwerde ist im Verfahren nach Art. 108 BGG nicht einzutreten.

Die Gerichtskosten sind der Beschwerdeführerin aufzuerlegen (Art. 66 Abs. 1 BGG). Das Gesuch um unentgeltliche Rechtspflege ist in Anwendung von Art. 64 BGG abzuweisen, weil die Rechtsbegehren aussichtslos erschienen. Der finanziellen Lage der Beschwerdeführerin ist durch eine herabgesetzte Gerichtsgebühr Rechnung zu tragen (Art. 65 Abs. 2 BGG). Dem Beschwerdegegner ist keine Entschädigung auszurichten, weil er vor Bundesgericht keine Umtriebe hatte.
Demnach erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.

2.
Das Gesuch um unentgeltliche Rechtspflege wird abgewiesen.

3.
Die Gerichtskosten von Fr. 500.-- werden der Beschwerdeführerin auferlegt.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Luzern, Kriminal- und Anklagekommission, schriftlich mitgeteilt.
