Resumo Omnilex

The Federal Supreme Court did not enter into the complaint against the dismissal of a fraud investigation. It held that the complainant lacked standing under Art. 81 BGG because she was neither a private prosecutor nor a victim; as a non-victim injured party, she could not challenge the termination. The complaint was therefore inadmissible under the summary procedure of Art. 108 BGG. Court costs of CHF 800 were charged to the appellant.

Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin, vertreten durch Rechtsanwalt Philipp Simmen,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich, Beschwerdegegnerin.

Gegenstand
Einstellung der Untersuchung (Betrug),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 8. Dezember 2008.

Der Präsident zieht in Erwägung:

1.

3.

Questão jurídica principal

Whether the complainant had standing to appeal the termination of the fraud investigation.

Decisão extraída

She had no standing because she was neither a private prosecutor nor a victim within the meaning of the Federal Supreme Court Act; as a merely injured non-victim party, she could not appeal.

Fundamentação extraída

The court held that the appellant did not satisfy Art. 81(1)(b) No. 4 or No. 5 BGG. Under the established case law, a non-victim injured party lacks standing to contest the dismissal of a criminal investigation.

Questão jurídica principal

Allocation of court costs.

Decisão extraída

Court costs were imposed on the appellant.

Fundamentação extraída

Because the appeal was not entered into, the appellant had to bear the costs.
