Resumo Omnilex

X.________ filed a federal criminal complaint against a cantonal non-entry decision concerning trespass and unlawful data acquisition, while also trying to raise defamation issues that were not finally decided below. The Federal Court held that she lacked standing as neither private prosecutor nor directly injured person, and that only separable formal-denial-of-justice complaints could be examined. Her submissions were either impermissibly directed at the merits or insufficiently reasoned. The court therefore did not enter into the complaint, denied free legal aid, and imposed reduced court costs of CHF 500.

Sumário Omnilex

Art. 81 Abs. 1 lit. b Ziff. 4 und 5 BGG; Art. 106 Abs. 2, Art. 108, Art. 64 und Art. 66 Abs. 1 BGG; standing of an injured person in criminal complaints and limits of review for non-legitimized appellants. A person who is merely affected as a damaged party, but not as a directly injured person within the meaning of the Victims Protection Act, is in principle not entitled to challenge a cantonal non-entry decision on the merits. If the public prosecution authority participated in the cantonal proceedings, private-prosecutor standing is excluded. Such a party may invoke only formal rights whose violation amounts to a denial of justice and can be separated from the substantive merits; arguments requiring review of the merits are inadmissible. Claims must be specifically reasoned; otherwise the complaint is not entered into. Free legal aid is refused when the appeal lacks prospects of success.

Urteil vom 24. April 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Generalprokurator des Kantons Bern, Hochschulstrasse 17, 3012 Bern,
Beschwerdegegner.

Gegenstand
Nichteintretensbeschluss (Hausfriedensbruch, unbefugte Datenbeschaffung),

Whether the federal complaint could challenge the unresolved defamation-related points.

Decisão extraída

No; the complaint could only concern the non-entry decision on trespass and unlawful data acquisition, not the defamation issues still pending at cantonal level.

Fundamentação extraída

Those points were not finally decided below, so the Federal Court could not enter into them under the finality requirement.

Questão jurídica principal

Whether the complainant had standing to challenge the non-entry decision as a private prosecutor or injured person.

Decisão extraída

No; she was neither a private prosecutor within the meaning of the Federal Supreme Court Act nor an injured person directly affected in her physical, psychological, or sexual integrity.

Fundamentação extraída

Because the public prosecutor participated in the cantonal proceedings and the alleged offences did not directly affect the protected integrity interests, she lacked ordinary appeal standing as a mere injured party.

Questão jurídica principal

Whether alleged procedural violations could be examined despite the lack of standing on the merits.

Decisão extraída

Only formal legal denials of justice that can be separated from the merits could be raised; the asserted complaints did not meet that threshold or were insufficiently reasoned.

Fundamentação extraída

A non-legitimized appellant may invoke only procedural rights whose violation amounts to a formal denial of justice; criticism requiring review of the merits is excluded, and some grievances were inadequately substantiated.

Questão jurídica principal

Whether free legal aid should be granted.

Decisão extraída

No; the request was refused because the complaint had no prospects of success.

Fundamentação extraída

The appeal was manifestly inadmissible and thus hopeless.
