Resumo Omnilex

The Federal Supreme Court held that the complainant lacked standing to challenge the cantonal prosecutor’s refusal to open a criminal investigation for false testimony. He was neither a private prosecutor, victim, nor complainant within Art. 81(1)(b)(4)-(6) BGG and had no other legally protected interest. The complaint was therefore not entered into under Art. 108 BGG. Court costs of CHF 800 were charged to the complainant.

Sumário Omnilex

Art. 81 BGG; standing to appeal against a refusal to open criminal proceedings; a complainant must be personally entitled under Art. 81(1)(b)(4)-(6) BGG or otherwise show a legally protected interest. A mere reporting party or person dissatisfied with a non-opening decision is not entitled to file a complaint in criminal matters. If standing is absent, the Federal Supreme Court may dispose of the matter by non-entry under Art. 108 BGG; costs are allocated to the unsuccessful party under Art. 66(1) BGG.

Urteil vom 1. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Graubünden, Sennhofstrasse 17, 7001 Chur.

Gegenstand

April 2007.

Das Präsidium zieht in Erwägung:
1.
Der Beschwerdeführer reichte am 26. Oktober 2006 Strafanzeige gegen A.________ wegen falschen Zeugnisses ein.
