Resumo Omnilex

The Federal Supreme Court did not enter into the appellant's criminal appeal against a Bernese appellate judgment fining him CHF 500 for speeding and not wearing a seat belt. It held that the constitutional complaints were insufficiently reasoned and that the appellant failed to show manifestly incorrect fact-finding. The appeal was therefore inadmissible under the summary procedure of Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Sumário Omnilex

Art. 106 Abs. 2 BGG, Art. 97 Abs. 1 BGG, Art. 108 BGG; requirements for admissibility of a criminal appeal. A complaint that invokes constitutional rights must be reasoned specifically and in detail; a merely appellatory critique of the facts is insufficient. The appellant must show, with reference to the challenged findings, why the cantonal court's factual determinations are manifestly incorrect within the meaning of Art. 97 Abs. 1 BGG. If these requirements are not met, the Federal Supreme Court does not enter into the appeal in the procedure under Art. 108 BGG (consid. 1). Cost allocation follows Art. 66 Abs. 1 BGG.

Urteil vom 29. April 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Postfach 7475, 3001 Bern.

Gegenstand

Strafkammer, vom 8. Februar 2007.

Das Präsidium zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, dem Generalprokurator des Kantons Bern und dem Obergericht des Kantons Bern, 1. Strafkammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the criminal appeal met the Federal Supreme Court's reasoning and factual-review requirements

Decisão extraída

The appeal did not satisfy the required reasoning and did not show that the facts were established manifestly incorrectly; the court therefore did not enter into the appeal.

Fundamentação extraída

The complaints about constitutional rights were inadequately reasoned under Art. 106(2) BGG, and the appellant merely challenged the facts without demonstrating manifest factual error under Art. 97(1) BGG. Non-entry was proper under Art. 108 BGG.

Questão jurídica principal

Allocation of federal court costs

Decisão extraída

Court costs were charged to the appellant.

Fundamentação extraída

As the appeal was inadmissible, the appellant had to bear the costs under Art. 66(1) BGG.
