Resumo Omnilex

The Federal Supreme Court held that the appellant was not directly affected in a legally protected interest and therefore lacked standing to challenge the refusal to prosecute a municipal official. His constitutional and human-rights arguments were insufficiently reasoned. The court did not enter into the appeal, denied free legal aid because the claims were hopeless, and imposed reduced court costs of CHF 500 on the appellant.

Sumário Omnilex

Art. 81 Abs. 1 lit. b Ziff. 5 BGG; standing in criminal matters requires direct impairment of legally protected interests, not mere aggrievement; an appellant alleging only indirect harm is not entitled to appeal. Art. 106 Abs. 2 BGG demands precise substantiation of constitutional or human-rights grievances; absent such reasoning, the complaint is inadmissible. Under Art. 108 BGG the court may decide non-entry in summary procedure. Free legal aid under Art. 64 BGG is excluded where the appeal lacks prospects of success; costs are imposed under Art. 66 Abs. 1 BGG, with consideration of financial circumstances under Art. 65 Abs. 2 BGG.

Urteil vom 4. Januar 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Amtsstatthalteramt Luzern, 6011 Kriens,
Beschwerdegegner.

Gegenstand
Vonderhandweisungsentscheid,

Whether the appellant had standing to bring the federal criminal appeal

Decisão extraída

He lacked standing because he was not shown to be directly affected in his physical or psychological integrity and, at most, was only a person allegedly harmed.

Fundamentação extraída

The court found no indication that the alleged coercion to remain in his business premises made him an injured party under Art. 81(1)(b) No. 5 BGG; as merely an aggrieved person, he was not entitled to appeal.

Questão jurídica principal

Whether the constitutional and human-rights complaints met the federal reasoning requirements

Decisão extraída

No; the submissions did not satisfy the required level of substantiation.

Fundamentação extraída

The appeal did not comply with Art. 106(2) BGG for complaints alleging constitutional or human-rights violations.

Questão jurídica principal

Whether the appeal should be entered into under the summary non-entry procedure

Decisão extraída

No; the appeal was not entered into.

Fundamentação extraída

Because standing and substantiation were lacking, the appeal failed at the threshold and had to be dealt with under Art. 108 BGG.

Questão jurídica principal

Whether free legal aid should be granted

Decisão extraída

No; the request was rejected because the appeal had no prospects of success.

Fundamentação extraída

Under Art. 64 BGG, legal aid is unavailable where the claims are manifestly hopeless.

Questão jurídica principal

Who bears the court costs

Decisão extraída

The appellant must pay CHF 500 in costs, with his financial situation taken into account.

Fundamentação extraída

Costs were imposed under Art. 66(1) BGG and the fee was moderated in light of Art. 65(2) BGG.
