Resumo Omnilex

The Federal Supreme Court dealt with a constitutional complaint against a cantonal cost order in an access-to-files matter. It held that only the subsidiary constitutional complaint was available, since the value in dispute was not reached and no question of fundamental importance arose. Because the complainant did not allege or substantiate any violation of constitutional rights with the required precision, the court declined to enter into the complaint in simplified procedure. The complainant was ordered to pay federal court costs of CHF 300.

Art. 113 ff., Art. 116, Art. 117 i.V.m. Art. 106 Abs. 2 and Art. 108 Abs. 1 lit. b BGG; subsidiäre Verfassungsbeschwerde and requirement of substantiation of constitutional rights. Where the appeal amount is not reached and no question of fundamental importance arises, only the subsidiary constitutional complaint is available. Such remedy requires, under strict pleading standards, a clear and detailed invocation of specific constitutional rights and an explanation of the alleged violation based on the cantonal decision; a mere dissatisfaction with the outcome is insufficient. If these requirements are not met, the court does not enter into the matter in simplified procedure. Costs follow the outcome under Art. 66 Abs. 1 BGG.

Urteil vom 18. September 2009
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Parteien
X.________,
Beschwerdeführerin,

gegen

Bezirksgericht Y.________,
Beschwerdegegner.

Gegenstand
Kosten (Akteneinsicht),

in Erwägung,

Whether the matter could be reviewed by ordinary appeal rather than subsidiary constitutional complaint.

Decisão extraída

Only the subsidiary constitutional complaint was available because the challenged cost order did not reach the statutory value threshold and no legal question of fundamental importance arose.

Fundamentação extraída

The complaint targeted solely the costs, not a claim reaching the threshold for appeal.

Questão jurídica principal

Whether the constitutional complaint met the pleading requirements for alleged violations of constitutional rights.

Decisão extraída

No. The complainant did not invoke or substantiate any constitutional rights with the required clarity and detail.

Fundamentação extraída

A subsidiary constitutional complaint must specifically identify the constitutional rights allegedly violated and explain the violation based on the cantonal decision; this was entirely absent.

Questão jurídica principal

Whether the complaint should be entered into or dismissed without examination.

Decisão extraída

The complaint was not entered into because it was obviously insufficiently reasoned.

Fundamentação extraída

Under the simplified procedure, an inadequately reasoned constitutional complaint is inadmissible.

Questão jurídica principal

Who bears the federal court costs.

Decisão extraída

The unsuccessful complainant bears the court costs.

Fundamentação extraída

Costs follow the outcome under the Federal Supreme Court Act.
