Resumo Omnilex

The Federal Court declared inadmissible an appeal against a cantonal judgment confirming involuntary placement for assistance. It held that the appellant lacked a current legal interest because the challenged judgment had been replaced by a later decision of the cantonal justice department. It also found the filing unmotivated under Art. 55 para. 1 lit. c OJ. In addition, the court noted that even an appeal against the later decision would have been inadmissible because that decision was still open to cantonal administrative appeal and was not a final cantonal decision. No court fee was imposed.

Sumário Omnilex

Art. 55 al. 1 let. c OJ; Art. 48 al. 1 OJ; admissibility of an appeal to the Federal Court requires both a current legal interest and a reasoned submission. The absence of current interest is not cured by the mere fact that a later act has replaced the challenged decision; where the contested measure has lost effect in favor of a new decision, the appeal becomes inadmissible. Independently, a filing lacking any motivation does not satisfy the statutory requirements. A decision that remains challengeable before a cantonal appellate authority is not a final decision of the canton’s highest court and cannot be directly brought before the Federal Court (consid. 1-3).

IIe COUR CIVILE

Composition de la Cour: MM. les Juges Reeb, président,
Bianchi et Meyer. Greffier: M. Fellay.

________

Statuant sur le recours interjeté

par
V.________,

contre
le jugement rendu le 19 juillet 2001 par la Chambre administrative du Tribunal cantonal du canton du Jura;

(privation de liberté à des fins d'assistance)

Considérant :

que le jugement attaqué confirme une décision de privation de liberté à des fins d'assistance prise le 4 juillet 2001 à l'encontre du recourant;

que le recours, traité comme recours en réforme, ne répond pas à l'exigence de l'intérêt actuel (cf. Messmer/Imboden, Die eidgenössischen Rechtsmittel in Zivilsachen, Zurich 1992, p. 116 ch. 85), dès lors qu'au moment de son dépôt, le recourant n'était plus interné en vertu du jugement attaqué, mais en vertu d'une décision prise le 9 août 2001 par le Département cantonal de la justice et qui s'est substituée audit jugement;

que faute de contenir une motivation, le recours ne satisfait pas non plus aux exigences de l'art. 55 al. 1 let. c de la loi fédérale d'organisation judiciaire (OJ);

qu'il serait irrecevable même s'il était dirigé contre la décision du 9 août 2001, car celle-ci peut faire l'objet d'un recours à la Cour administrative du Tribunal cantonal et ne constitue donc pas une décision finale prise par le tribunal suprême du canton (art. 48 al. 1 OJ);

que le présent arrêt peut être rendu sans frais;

Par ces motifs,

le Tribunal fédéral,

vu l'art. 36a OJ:

  1. Déclare le recours irrecevable

  2. Dit qu'il n'est pas perçu d'émolument judiciaire.

  3. Communique le présent arrêt en copie au recourant et à la Chambre administrative du Tribunal cantonal du canton du Jura.

Questão jurídica principal

Whether the appeal met the requirement of current legal interest.

Decisão extraída

It did not, because the appellant was no longer detained under the challenged judgment but under a later administrative decision that had superseded it.

Fundamentação extraída

An appeal requires an existing current interest; once the challenged judgment has been replaced, that interest falls away.

Questão jurídica principal

Whether the appeal satisfied the Federal Court's motivation requirements.

Decisão extraída

It did not, because the filing contained no motivation within the meaning of Art. 55 para. 1 lit. c OJ.

Fundamentação extraída

A motivated submission is an independent admissibility requirement; its absence renders the appeal inadmissible.

Questão jurídica principal

Whether the later decision of 9 August 2001 could be directly challenged before the Federal Court.

Decisão extraída

No; it was subject to appeal to the cantonal administrative court and therefore was not a final decision of the canton's highest court within the meaning of Art. 48 para. 1 OJ.

Fundamentação extraída

Federal Court review required exhaustion of the cantonal judicial instance; that condition was not met.
