The Federal Supreme Court held that the appeal against the cantonal decision dismissing the husband’s appeal in a marriage-protection case was out of time. It noted that the filing was only received by the Swiss Post on 23 November 2011 and was therefore late under the Federal Supreme Court Act, even accepting the appellant’s claimed earlier receipt of the cantonal judgment by email. The Court further observed that the appeal would also fail for lack of sufficient reasoning, since the appellant did not address the decisive procedural issue or claim to have sought cantonal legal aid. The appeal was declared inadmissible, with no court costs charged.

A federal appeal is inadmissible if it is lodged after expiry of the statutory period; for postal filings, the relevant date is the handing over to the postal service. Independently thereof, the appeal must contain reasoning addressing the decisive considerations of the challenged decision; mere discussion of the merits or unsupported assertions do not satisfy the requirements of Art. 42 al. 2 and Art. 106 al. 2 LTF. If the case can be decided without costs, the question of federal legal aid may become moot (consid. 1).

Considérant:
que l'arrêt attaqué, notifié à l'adresse du recourant en Suisse le 21 octobre 2011, déclare irrecevable et raye du rôle, faute de paiement de l'avance de frais dans le délai imparti, l'appel qu'il a interjeté contre le jugement de mesures protectrices de l'union conjugale rendu le 20 juillet 2011 par le Tribunal civil de l'arrondissement de Lausanne dans la cause l'opposant à dame A.________;
que le recours, posté le samedi 19 novembre 2011 en Inde et parvenu seulement le mercredi 23 novembre 2011 à la Poste Suisse, est tardif au regard des art. 48 al. 1 et 100 al. 1 LTF;
qu'il le serait même s'il fallait suivre la version du recourant qui prétend avoir reçu l'arrêt attaqué par e-mail le 22 octobre 2011;
qu'il doit par conséquent être déclaré irrecevable en procédure simplifiée (art. 108 al. 1 let. a LTF);
que même s'il avait été déposé en temps utile, le recours aurait de toute façon été déclaré irrecevable faute de contenir une motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF, le recourant faisant certes valoir qu'il n'aurait pas pu payer l'avance de frais, sans même toutefois prétendre qu'il aurait sollicité l'assistance judiciaire au plan cantonal, et s'en prenant pour le reste au fond de l'affaire;
que le présent arrêt pouvant être rendu sans frais (art. 66 al. 1, seconde phrase, LTF), la demande implicite d'assistance judiciaire du recourant au plan fédéral devient sans objet;
par ces motifs, la Présidente prononce:

Le recours est irrecevable.
2.
Il n'est pas perçu de frais judiciaires.
3.
Le présent arrêt est communiqué aux participants à la procédure et au Juge délégué de la Cour d'appel civile du Tribunal cantonal du canton de Vaud.

Whether the federal appeal was filed within the statutory time limit
The appeal was filed out of time under Arts. 48(1) and 100(1) LTF.
It was mailed on 19 November 2011 in India and reached the Swiss Post only on 23 November 2011, which was too late even under the appellant's alleged receipt date of 22 October 2011.
