Resumo Omnilex

The Federal Supreme Court dealt with an appeal in a family protective-measures case. The appellant challenged an appellate cantonal decision, but the Court held that the 30-day filing deadline had expired because the cantonal decision was served on 2013-11-19 and the appeal was only posted on 2014-01-06. The time-limits suspension did not apply. The Court therefore did not enter into the appeal, declared the request for suspensive effect moot, denied legal aid for lack of prospects, and imposed CHF 500 in court costs on the appellant.

Sumário Omnilex

Art. 100 Abs. 1, Art. 48 Abs. 1, Art. 46 Abs. 2 and Art. 108 Abs. 1 lit. a BGG; timeliness of an appeal against a decision under Art. 98 BGG. In proceedings concerning interim measures, the statutory suspension of deadlines does not apply; the appeal period runs uninterrupted. An appeal filed after expiry of the 30-day period is manifestly inadmissible and is disposed of by non-entry in simplified procedure. Where the appeal is hopeless, legal aid must be refused under Art. 64 Abs. 1 BGG; the unsuccessful appellant bears the costs under Art. 66 Abs. 1 BGG. A request for suspensive effect becomes moot when no substantive review is entered into (consid. 1-4).

Gegenstand
Eheschutz,

Beschwerde nach Art. 72 ff. BGG gegen den Entscheid vom 11. November 2013 des Obergerichts des Kantons Aargau (Zivilgericht, 5. Kammer).

in Erwägung,

Whether the appeal against the cantonal protective-measures decision was timely and admissible.

Decisão extraída

The appeal was filed after the deadline and was therefore manifestly inadmissible.

Fundamentação extraída

The cantonal decision was served on 2013-11-19, so the 30-day deadline expired on 2013-12-19. The filing on 2014-01-06 was late; the suspension of time limits did not apply under Art. 46(2) BGG for a decision under Art. 98 BGG.

Questão jurídica principal

Whether the request for suspensive effect should be granted.

Decisão extraída

The request became moot once the appeal was not entered upon.

Fundamentação extraída

A decision on the appeal itself rendered the interim request without object.

Questão jurídica principal

Whether legal aid for the Federal Supreme Court proceedings should be granted.

Decisão extraída

Legal aid was denied because the appeal had no prospects of success.

Fundamentação extraída

Because the appeal was obviously inadmissible, the statutory condition of non-frivolous prospects was not met.

Questão jurídica principal

Who bears the court costs of the Federal Supreme Court proceedings.

Decisão extraída

The appellant must bear the court costs.

Fundamentação extraída

The losing party is liable for costs under Art. 66(1) BGG.
