Resumo Omnilex

The Swiss Federal Supreme Court dealt with an appeal against a cantonal order that had struck a challenge to an involuntary commitment as withdrawn. It held that the appellant’s filing did not address the cantonal court’s reasoning in a legally cognizable way and did not show any violation of federal or constitutional law. The court therefore did not enter into the appeal under Art. 108 Abs. 1 lit. b BGG. No court costs were charged.

Sumário Omnilex

Art. 42 Abs. 1 and 2 BGG, Art. 106 Abs. 2 BGG, Art. 108 Abs. 1 lit. b BGG; requirements of appeal motivation and non-entry: an appeal must, in reference to the reasoning of the contested decision, set out in a succinct manner why that decision violates federal law; constitutional grievances are subject to qualified pleading and substantiation. A merely appellatory or unexplained submission is insufficient. If the motivation requirement is not met, the appeal is not entered into in simplified procedure under Art. 108 BGG; costs may be waived in the circumstances of the case (consid. 1).

Urteil vom 5. Januar 2010
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Amtsarzt des Kantons St. Gallen,

Gegenstand

in Erwägung,
