Resumo Omnilex

The appellant challenged a cantonal decision declaring his appeal inadmissible. The Federal Supreme Court held that his federal appeal did not meet the statutory motivation requirements because he failed to address the cantonal reasoning and instead only restated his own view of the dispute. The appeal was therefore inadmissible and decided in simplified procedure by the President. The Court also rejected the appellant’s implied request to reconsider the refusal of legal aid, finding no grounds for reconsideration. Court costs of CHF 2,000 were imposed on the appellant, and the Court warned that further abusive filings in the same procedure would be filed without response.

Sumário Omnilex

Art. 42 cpv. 2, Art. 106 cpv. 2, Art. 108 cpv. 1 lett. b e c LTF; insufficiency of motivation of the federal appeal. The appeal must, in a manner tailored to the challenged decision, show why it violates law; mere presentation of one’s own version of the facts or dispute does not satisfy the requirement. Where the complaint does not engage with the decisive reasons of the cantonal judgment, the Federal Supreme Court will not enter into the matter. Constitutional and cantonal-law grievances are examined only if specifically invoked and substantiated. Abusive submissions may be disposed of summarily; costs follow the unsuccessful party pursuant to Art. 66 cpv. 1 LTF.

Sentenza del 15 dicembre 2009
II Corte di diritto civile

Composizione
Giudice federale Hohl, Presidente,
Cancelliere Piatti.

Parti
A.________,
ricorrente,

contro

B.________, patrocinata dall'avv. Stefano Pizzola,
opponente.

Oggetto
Contributi per spese comuni,

ricorso contro la sentenza emanata il 28 settembre 2009 dalla I Camera civile del Tribunale di appello del Cantone Ticino.
Considerando:
che con sentenza del 31 luglio 2009 il Pretore del distretto di Lugano ha accolto la petizione inoltrata dalla B.________ nei confronti di A.________, ha condannato quest'ultimo a versare all'attrice fr. 98'970.55 e ha ordinato all'Ufficiale del registro fondiario del medesimo distretto di iscrivere in via definitiva un'ipoteca legale sulla proprietà del convenuto;
che con sentenza del 28 settembre 2009 la I Camera civile del Tribunale di appello del Cantone Ticino ha dichiarato inammissibile, per carente motivazione, un appello presentato da A.________;
che con ricorso del 31 ottobre 2009 al Tribunale federale A.________ ha impugnato quest'ultima sentenza;
che con decreto del 12 novembre 2009 la Presidente della Corte adita ha respinto, per carenza di probabilità di esito favorevole del ricorso, una domanda di assistenza giudiziaria formulata dal ricorrente;
che giusta l'art. 42 cpv. 2 LTF nella motivazione del ricorso occorre spiegare perché l'atto impugnato viola il diritto e che in virtù dell'art. 106 cpv. 2 LTF il Tribunale federale esamina la violazione di diritti fondamentali e di disposizioni di diritto cantonale e intercantonale soltanto se il ricorrente ha sollevato e motivato tale censura;
che in concreto il ricorso non rispetta i predetti requisiti di motivazione;
che infatti il ricorrente, per quanto il suo rimedio risulti comprensibile, non si confronta con i motivi della sentenza cantonale, ma si limita a fornire la propria versione della lite che lo oppone all'attrice senza però indicare i motivi per cui il suo appello sarebbe invece stato ricevibile;
che pertanto il ricorso, peraltro abusivo (art. 42 cpv. 7 LTF), si rivela inammissibile e può essere deciso dalla Presidente della Corte nella procedura semplificata (art. 108 cpv. 1 lett. b e c LTF);
che il 1° dicembre 2009 il ricorrente ha - implicitamente - chiesto una riconsiderazione, senza però prevalersi di motivi che potrebbero giustificarla, del decreto del 12 novembre 2009 sulla domanda di assistenza giudiziaria;

che in queste circostanze la domanda di riconsiderazione dev'essere respinta;
che le spese giudiziarie seguono quindi la soccombenza (art. 66 cpv. 1 LTF);
che infine si avverte il ricorrente che il Tribunale federale archivierà senza risposta ulteriori scritti abusivi (e segnatamente domande di revisione abusive) analoghi al ricorso in esame e concernenti questa procedura;

per questi motivi, la Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Le spese giudiziarie di fr. 2'000.-- sono poste a carico del ricorrente.

3.
Comunicazione alle parti e alla I Camera civile del Tribunale di appello del Cantone Ticino.
