Resumo

The Federal Supreme Court took note of the appellant’s withdrawal of her divorce appeal against the Geneva Civil Chamber’s judgment of 18 September 2009. The matter was removed from the docket. The court ordered judicial costs of CHF 300 against the appellant. Before the withdrawal, the court had twice ordered payment of an advance on costs, first in the amount of CHF 3,000 and then granting an additional 10-day period to pay.

Art. 73 PCF in conjunction with Art. 71 LTF; Art. 32 al. 2 LTF: when an appeal is withdrawn, the Federal Supreme Court takes note of the withdrawal and strikes the case from the docket. The withdrawal terminates the proceedings without a merits decision. Costs are allocated against the withdrawing appellant under Art. 5 al. 2 PCF in conjunction with Art. 71 LTF and Art. 66 paras. 1 and 2 LTF (consid. 1-2).

l'ordonnance présidentielle du 18 novembre 2009, accordant à la recourante un délai supplémentaire de 10 jours pour payer l'avance de frais, conformément à l'art. 62 al. 3 LTF;
la déclaration de retrait du recours du 27 novembre 2009;
considérant:
qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que les frais doivent être mis à la charge de la recourante (art. 5 al. 2 PCF par renvoi de l'art. 71 LTF; art. 66 al. 1 et 2 LTF);
par ces motifs, la Juge présidant ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.

2.
Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge de la recourante.

3.
La présente ordonnance est communiquée aux parties et à la Chambre civile de la Cour de justice du canton de Genève.
