In an appeal against a cantonal bankruptcy judgment, the appellant withdrew its appeal after the Federal Supreme Court had indicated that the appeal appeared to have no chance of success. The President took note of the withdrawal and ordered the case struck from the docket. The appellant was ordered to pay a judicial fee of CHF 300. The order was communicated to the parties and the relevant cantonal authorities.
Art. 73 PCF in conjunction with Art. 71 LTF and Art. 32 al. 2 LTF; withdrawal of the appeal before judgment. When the appellant withdraws the appeal, the Federal Supreme Court takes note of the withdrawal and strikes the case from the docket without ruling on the merits. Under Art. 66 al. 1 LTF, the judicial fee is in principle borne by the withdrawing appellant.

considérant:
qu'il y a lieu de prendre acte du retrait du recours et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que l'émolument judiciaire incombe à la recourante (art. 66 al. 1 LTF);
par ces motifs, la Présidente ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.
2.
Un émolument judiciaire de 300 fr. est mis à la charge de la recourante.
3.
La présente ordonnance est communiquée aux parties, à l'Office des faillites de Lausanne, au Conservateur du Registre foncier de Lausanne, au Registre du commerce du canton de Vaud, à l'Office des poursuites du district de Lausanne et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.

Whether the appeal withdrawal should be taken on record and the case removed from the docket
The withdrawal was taken on record and the proceedings were terminated by striking the case from the docket.
Once the appellant declared withdrawal of the appeal, there was no need to decide the merits; the case had to be removed from the docket under the applicable procedural provisions.
Allocation of the court fee after withdrawal of the appeal
A court fee of CHF 300 was imposed on the appellant.
Under the Federal Supreme Court rules on costs, the withdrawing appellant bears the judicial fee.
