The Federal Supreme Court noted that the appellant withdrew his appeal by letter of 29 April 2009 in a family-law protection case. The II. Civil Law Division therefore struck the proceedings from the docket without examining the merits. In applying the procedural rules on withdrawal, the Court ordered court costs of CHF 300 against the appellant and notified the parties and the Bern cantonal appellate court.

Art. 73 BZP) und die Kosten dem Beschwerdeführer aufzuerlegen sind (Art. 71 BGG i.V.m. Art. 5 Abs. 2 BZP, Art. 66 Abs. 1 BGG),
verfügt die Präsidentin:

Das Verfahren wird als durch Rückzug der Beschwerde erledigt abgeschrieben.
2.
Die Gerichtskosten von Fr. 300.-- werden dem Beschwerdeführer auferlegt.

Whether the appeal should be struck off after the appellant's withdrawal
The proceedings were discontinued and struck off as terminated by withdrawal of the appeal.
Once the appellant withdrew the filing, the appeal no longer needed substantive adjudication and the case had to be dismissed from the docket.
Allocation of court costs after withdrawal of the appeal
Court costs of CHF 300 were imposed on the appellant.
Under the applicable procedural rules, costs follow the withdrawing appellant.
