The appellant withdrew his appeal against a land-register blocking order. The II Civil Law Division therefore struck the proceedings off as withdrawn. It ordered the appellant to pay court costs of CHF 1,000 and to compensate the respondent CHF 500 for her submission on the request for suspensive effect. The decision was issued by the Division President.

in das Schreiben des Beschwerdeführers vom 6. Mai 2009,
in Erwägung,
dass der Beschwerdeführer die erwähnte Eingabe mit Schreiben vom 6. Mai 2008 zurückgezogen hat, die Beschwerde daher durch die Abteilungspräsidentin (Art. 32 Abs. 2 BGG) abzuschreiben ist (Art. 71 BGG i.V.m. Art. 73 BZP) und die Kosten dem Beschwerdeführer aufzuerlegen sind (Art. 71 BGG i.V.m. Art. 5 Abs. 2 BZP, Art. 66 Abs. 1 und 5 BGG),
dass bei der Höhe der Kosten auch die Verfügung betreffend aufschiebende Wirkung vom 5. Mai 2009 zu berücksichtigen sind,
dass die Beschwerdegegnerin Abweisung des Gesuchs um aufschiebende Wirkung beantragt hat und damit durchgedrungen ist und folglich Anspruch auf eine Entschädigung für das Zwischenverfahren hat (Art. 68 Abs. 1 und 4 BGG),
verfügt die Präsidentin:

Das Verfahren wird als durch Rückzug der Beschwerde erledigt abgeschrieben.
2.
Die Gerichtskosten von Fr. 1'000.-- werden dem Beschwerdeführer auferlegt.
3.
Der Beschwerdeführer hat die Beschwerdegegnerin für die Stellungnahme zum Gesuch um aufschiebende Wirkung mit Fr. 500.-- zu entschädigen.
4.
Diese Verfügung wird den Parteien und dem Bezirksgerichtsausschuss Maloja schriftlich mitgeteilt.

Whether the appeal should be struck off after the appellant's withdrawal
The proceedings were discontinued and struck off as withdrawn.
Once the appellant withdrew the filed appeal, the Division President could terminate the case by striking it off under the applicable procedural rules.
Who bears the court costs after withdrawal
The court costs were imposed on the appellant.
Costs follow the withdrawal; the appellant had to bear the costs, with the amount taking account of the earlier stay-of-execution order.
Whether the respondent is entitled to compensation for the interim stay-of-execution proceedings
The respondent was awarded compensation for responding to the request for suspensive effect.
Because the respondent succeeded in opposing the request for suspensive effect, she was entitled to compensation for that intermediate proceeding.
