Resumo Omnilex

X. appealed to the Federal Supreme Court against a cantonal decision concerning involuntary commitment. The Court held that a fax submission does not meet the statutory filing requirements under the BGG. It therefore refused to enter into the appeal under Art. 108(1)(a) BGG. The case was handled in simplified procedure by the chamber president, and no court costs were levied.

Sumário Omnilex

Art. 48 Abs. 1 BGG, Art. 42 Abs. 4 BGG; form of filing before the Federal Supreme Court. An appeal to the Federal Supreme Court is admissible only if lodged by hand delivery to the Court or by post, or electronically with a recognized electronic signature. A transmission by fax does not satisfy the statutory form requirements and is ineffective; the Court does not enter on the appeal under Art. 108 Abs. 1 lit. a BGG. In such non-entry cases, simplified procedure applies; court costs may be waived.

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Parteien
X.________,

gegen

Regierungsstatthalteramt Y.________,
verfahrensbeteiligtes Amt.

Gegenstand
Fürsorgerische Freiheitsentziehung,

Beschwerde nach Art. 72 ff. BGG gegen das Urteil vom 21. Januar 2010 des Obergerichts des Kantons Bern (Kantonale Rekurskommission für fürsorgerische Freiheitsentziehungen).

Nach Einsicht
in die Beschwerde gemäss Art. 72 ff. BGG gegen das Urteil vom 21. Januar 2010 des Obergerichts des Kantons Bern,

in Erwägung,
