In a civil appeal concerning divorce, the appellant withdrew the federal appeal after filing it. The President of the II Civil Division of the Federal Supreme Court therefore struck the proceedings from the docket. The request for free legal aid became moot, and no court costs were imposed. The decision was notified to the parties and the Cantonal Court of Fribourg.
Art. 32 Abs. 2 BGG; Art. 71 BGG i.V.m. Art. 73 BZP: withdrawal of an appeal; discontinuance of proceedings and costs. If a federal appeal is withdrawn, the President may strike the matter from the list of cases. The withdrawal renders any pending request for free legal aid moot. In such circumstances, the court may dispense with levying judicial costs (consid. 1).

Art. 73 BZP), das Gesuch um unentgeltliche Rechtspflege (einschliesslich Rechtsvertretung) gegenstandslos wird und auf die Erhebung von Kosten zu verzichten ist,
verfügt die Präsidentin:

Das Verfahren 5A_149/2012 wird als durch Rückzug der Beschwerde erledigt abgeschrieben.

Es werden keine Gerichtskosten erhoben.

The appeal proceedings were struck off the docket because the appellant withdrew the appeal.
Once the appeal was withdrawn, the president ordered the proceedings discontinued under the applicable Federal Supreme Court procedural rules.
Whether court fees should be charged and legal aid remained to be decided.
No court fees were levied, and the request for free legal aid became moot.
Because the proceedings ended through withdrawal, the court dispensed with costs and the pending legal-aid request no longer required a decision.
