Resumo Omnilex

The claimant challenged a Zurich cantonal judgment dismissing his action for reimbursement of CHF 600 and CHF 10,000 satisfaction. The Federal Supreme Court held that a civil appeal was unavailable because the amount in dispute did not reach CHF 30,000 and no fundamental legal question was invoked. Treated as a subsidiary constitutional complaint, the filing still failed because it did not identify specific constitutional rights or address the cantonal reasoning. The Court therefore did not enter into the matter and waived court costs.

Sumário Omnilex

Art. 74 Abs. 1 lit. b and Abs. 2 lit. a BGG; Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 117 BGG; subsidiäre Verfassungsbeschwerde and requirement of substantiated constitutional reasoning. Where the value in dispute does not reach the statutory threshold for a civil-law appeal and no fundamental legal question is shown, the filing must be treated as a subsidiary constitutional complaint. Such a complaint is admissible only if it distinctly alleges the violation of constitutional rights and, by reference to the reasoning of the challenged decision, sets out substantiated criticism. A merely appellatory submission is insufficient and leads to non-entry under Art. 108 Abs. 1 lit. b BGG. In the absence of costs, the request for exemption from court costs becomes moot (Art. 66 Abs. 1 BGG).

Urteil vom 2. Juli 2008
I. zivilrechtliche Abteilung

Besetzung
Bundesrichter Corboz, Präsident,
Gerichtsschreiber Huguenin.

Parteien
A.________,
Beschwerdeführer,

gegen

B.________,
Beschwerdegegner.

Gegenstand
Auftrag,

Verfassungsbeschwerde gegen das Urteil des Obergerichts des Kantons Zürich, II. Zivilkammer,
vom 6. Mai 2008.

In Erwägung,
dass der Einzelrichter des Bezirks Zürich die vom Beschwerdeführer gegen den Beschwerdegegner erhobene Klage auf Zahlung von Fr. 600.-- (Rückerstattung des Honorars) und Fr. 10'000.-- (Genugtuung) mit Urteil vom 10. Januar 2008 abwies;
dass der Beschwerdeführer dieses Urteil mit Berufung anfocht, die vom Obergericht des Kantons Zürich mit Urteil vom 6. Mai 2008 abgewiesen wurde;
dass der Beschwerdeführer dem Bundesgericht eine vom 11. Juni 2008 datierte Eingabe einreichte, in der er erklärte, das Urteil des Obergerichts mit Beschwerde anzufechten;
dass die Beschwerde in Zivilsachen nach Art. 72 ff. BGG angesichts der Höhe der streitigen Forderung von weniger als Fr. 30'000.-- nicht erhoben werden kann (Art. 74 Abs. 1 lit. b BGG), und weder geltend gemacht wird noch ersichtlich ist, dass diese Beschwerde dennoch zulässig ist, weil sich eine Rechtsfrage von grundsätzlicher Bedeutung im Sinne von Art. 74 Abs. 2 lit. a BGG stellt;
dass die Eingabe des Beschwerdeführers unter diesen Umständen als subsidiäre Verfassungsbeschwerde im Sinne der Art. 113 ff. BGG zu behandeln ist;
dass in einer solchen Beschwerde dargelegt werden muss, welche verfassungsrechtlichen Grundrechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheids zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass die Eingabe des Beschwerdeführers vom 11. Juni 2008 diesen Begründungsanforderungen offensichtlich nicht genügt, weshalb auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass unter den gegebenen Umständen auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 BGG), womit das Gesuch um Befreiung von den Gerichtskosten gegenstandslos wird;

erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the federal filing could be treated as a civil-law appeal under Art. 72 ff. BGG

Decisão extraída

A civil-law appeal was unavailable because the amount in dispute was below CHF 30,000 and no exception for a legal question of fundamental importance was shown.

Fundamentação extraída

The disputed claim was under the statutory value threshold, and neither the appellant alleged nor the court saw a basis for an exception under Art. 74(2)(a) BGG.

Questão jurídica principal

Whether the filing met the requirements of a subsidiary constitutional complaint

Decisão extraída

The filing did not satisfy the strict reasoning requirements for a constitutional complaint and therefore could not be heard.

Fundamentação extraída

The appellant failed to specify which constitutional rights were violated and did not engage with the cantonal court’s reasoning as required by Arts. 42(2), 106(2), and 117 BGG.

Questão jurídica principal

Whether court costs should be charged

Decisão extraída

No court costs were levied in the circumstances.

Fundamentação extraída

Given the outcome, the Court waived costs under Art. 66(1) BGG, making the request for cost exemption moot.
