The appellant withdrew his subsidiary constitutional complaint against a Bern cantonal court decision in a tenancy termination case. The Swiss Federal Supreme Court therefore removed the matter from the docket. It ordered the appellant to pay CHF 300 in court costs and CHF 1,500 in compensation to the respondents. The later request for free legal aid was held to be moot because the cost advance had already been paid before the request was filed.

In Erwägung,
dass der Beschwerdeführer seine gegen den Entscheid des Obergerichts des Kantons Bern vom 28. April 2011 am 27. Mai 2011 eingereichte subsidiäre Verfassungsbeschwerde mit Eingabe vom 28. Oktober 2011 zurückgezogen hat;
dass das Verfahren deshalb als durch Rückzug der subsidiären Verfassungsbeschwerde abzuschreiben ist;
dass der Beschwerdeführer bei diesem Verfahrensausgang für das bundesgerichtliche Verfahren kosten- und entschädigungspflichtig wird;
dass der Beschwerdeführer den einverlangten Kostenvorschuss für das bundesgerichtliche Verfahren bereits am 14. Juni 2011 fristgerecht geleistet hatte, als er am 6. Oktober 2011 ein Gesuch um unentgeltliche Rechtspflege stellte;
dass dieses Gesuch somit bereits bei Einreichung gegenstandslos war;
verfügt die Instruktionsrichterin:
1.
Das Verfahren wird als durch Rückzug der Beschwerde erledigt abgeschrieben.
2.
Die Gerichtskosten von Fr. 300.-- werden dem Beschwerdeführer auferlegt.
3.
Der Beschwerdeführer hat die Beschwerdegegner für das bundesgerichtliche Verfahren mit insgesamt Fr. 1'500.-- zu entschädigen.
4.
Diese Verfügung wird den Parteien und dem Obergericht des Kantons Bern, Zivilabteilung, 1. Zivilkammer, schriftlich mitgeteilt.

Because the appellant withdrew the complaint, the federal proceedings had to be discontinued by removal from the docket.
