Resumo Omnilex

The Federal Supreme Court declined to hear the appellant's subsidiary constitutional complaint against a cantonal judgment in a storage-contract dispute. It held that the submission did not satisfy the statutory reasoning requirements because it failed to identify and substantiate the alleged violations of rights. The complaint was therefore not entered into. As the appellant was unsuccessful, she was ordered to pay a court fee of CHF 500.

Sumário Omnilex

Art. 42 Abs. 2, Art. 106 Abs. 2, Art. 117 and Art. 108 Abs. 1 lit. b BGG; requirements for a subsidiary constitutional complaint: the submission must, with reference to the grounds of the challenged decision, clearly indicate which constitutional rights were violated and in what respect. Mere criticism or unsubstantied assertions are insufficient. If these pleading requirements are not met, the Federal Supreme Court does not enter into the complaint. Court costs follow the outcome under Art. 66 Abs. 1 BGG.
