The Federal Supreme Court treated the tenant’s filings as a subsidiary constitutional complaint against an eviction order. It held that the complaint could not be examined insofar as it targeted a non-final cantonal decision and, in any event, the submissions did not meet the strict pleading requirements for constitutional grievances. The Court therefore issued a non-entry decision. No court costs were imposed.

A subsidiary constitutional complaint lies only against a final cantonal decision where no appeal in civil matters is available. It may invoke solely violations of constitutional rights. Under Art. 42(2), 106(2) and 117 BGG, the complaint must identify the constitutional guarantees allegedly infringed and, by reference to the reasoning of the impugned decision, set out a reasoned, specific critique; purely appellatory allegations are insufficient. If these requirements are manifestly not met, the Federal Supreme Court does not enter into the matter under Art. 108(1) lit. a and b BGG (consid. 1-3).

In Erwägung,
dass der Gerichtspräsident 1 des Gerichtskreises V Burgdorf-Fraubrunnen dem Beschwerdeführer mit Entscheid vom 24. Juni 2009 befahl, das von ihm belegte Zimmer im Anbau im 1. Obergeschoss des Restaurants Bahnhof, C.________-strasse 6 in D.________, bis spätestens 07.07.2009, 12.00 Uhr mittags, zu räumen und zu verlassen;
dass der Beschwerdeführer dem Bundesgericht eine vom 27. Juni 2009 datierte Eingabe einreichte, in der er erklärte, den Entscheid des Gerichtspräsidenten vom 24. Juni 2009 mit "Beschwerde gemäss Art. 113 des Bundesgesetzes vom 17. Juni 2005" anzufechten;
dass der Beschwerdeführer den Entscheid des Gerichtspräsidenten auch mit Nichtigkeitsklage beim Obergericht des Kantons Bern anfocht, dessen Appellationshof das Rechtsmittel mit Entscheid vom 12. August 2009 abwies;
dass auf die Beschwerde vom 27. Juni 2009 von vornherein nicht einzutreten ist, soweit der Entscheid des Gerichtspräsidenten nicht kantonal letztinstanzlich ergangen war (Art. 113 BGG);
dass die Eingaben des Beschwerdeführers vom 27. Juni 2009 und vom 10. September 2009 als subsidiäre Verfassungsbeschwerde im Sinne der Art. 113 ff. BGG zu behandeln sind, weil unter den gegebenen Umständen eine Beschwerde in Zivilsachen im Sinne der Art. 72 ff. BGG nicht in Frage kommt;
dass mit einer subsidiären Verfassungsbeschwerde ausschliesslich die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass die Eingaben des Beschwerdeführers vom 27. Juni 2009 und vom 10. September 2009 diese Anforderungen offensichtlich nicht erfüllen;
dass aus diesen Gründen auf die Beschwerde in Anwendung von Art. 108 Abs. 1 lit. a und b BGG nicht einzutreten ist;
dass unter den gegebenen Umständen auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 zweiter Satz BGG);
erkennt die Präsidentin:

Auf die Beschwerde wird nicht eingetreten.
2.
Es werden keine Gerichtskosten erhoben.
3.
Dieses Urteil wird den Parteien, dem Gerichtskreis V Burgdorf-Fraubrunnen und dem Obergericht des Kantons Bern, Appellationshof, 2. Zivilkammer, schriftlich mitgeteilt.

Whether the federal submission was admissible as an appeal against a non-final cantonal decision
It was inadmissible insofar as the challenged decision was not yet rendered by the last cantonal instance.
Under Art. 113 BGG, subsidiary constitutional complaints are only available against cantonal final decisions; the first submission could not be examined to the extent it targeted a non-final decision.
Whether the submissions satisfied the pleading requirements for a subsidiary constitutional complaint
They did not; the complaint failed to identify and reason concrete constitutional rights violations with reference to the challenged reasoning.
A subsidiary constitutional complaint may invoke only constitutional rights, and Art. 42(2), 106(2) in conjunction with Art. 117 BGG requires specific, substantiated constitutional objections. The filings manifestly failed to meet this standard.
Court costs
No court costs were charged in the circumstances.
Given the case posture, the Court exercised its discretion to waive costs under Art. 66(1) second sentence BGG.
