In a lease termination dispute, the Federal Supreme Court took note of the appellant’s withdrawal of his subsidiary constitutional complaint after his counsel filed a withdrawal letter. The Court therefore struck case 4D_117/2009 from the docket. It also ordered the appellant to pay a judicial fee of CHF 500. The prior request for legal aid had already been rejected and an advance on costs had been ordered, but the dispositive ruling concerned only the withdrawal and costs.
Art. 32 al. 2 LTF, art. 66 al. 2 LTF; withdrawal of the appeal and allocation of costs. When a legal remedy is withdrawn, the Federal Supreme Court takes note of the withdrawal and removes the case from the roll. In principle, the proceedings are thereby terminated without examination of the merits. Costs are allocated according to the statutory rules, in particular by charging the withdrawing party with the judicial fee unless the circumstances justify otherwise (consid. 1).

Vu l'ordonnance présidentielle du 19 novembre 2009 invitant le recourant à verser une avance de frais de 1'000 fr. jusqu'au 4 décembre 2009;
Vu l'ordonnance présidentielle du 14 décembre 2009 impartissant au recourant un délai non prolongeable au 15 janvier 2010 pour verser ladite avance;
Vu la lettre du 2 janvier 2010 par laquelle le mandataire du recourant a retiré le recours au nom du mandant;
Considérant qu'il y a lieu de prendre acte de ce retrait et de rayer la cause du rôle (art. 32 al. 2 LTF);
Vu, quant aux frais, l'art. 66 al. 2 LTF,
Ordonne:

Il est pris acte du retrait du recours.

La cause 4D_117/2009 est rayée du rôle.
3.
Un émolument judiciaire de 500 fr. est mis à la charge du recourant.

La présente ordonnance est communiquée aux mandataires des parties et à la Chambre d'appel en matière de baux et loyers du canton de Genève.

Whether the constitutional complaint should be taken off the docket after withdrawal
The court took note of the withdrawal and ordered the case struck from the docket.
Once the appellant's counsel withdrew the appeal on behalf of the client, there was no need to proceed; the court recorded the withdrawal and struck the case off the roll under Art. 32(2) LTF.
Allocation of court costs after withdrawal
A judicial fee of CHF 500 was charged to the appellant.
Costs were allocated pursuant to Art. 66(2) LTF.
