In a construction contract case, the plaintiff appealed a Zurich Commercial Court judgment to the Federal Supreme Court. While the federal appeal was pending, the Zurich Cassation Court upheld the cantonal nullity complaint, set aside the Commercial Court judgment, and remitted the matter for reconsideration. Because that cantonal decision was not challenged within the federal time limit, the appealed judgment no longer stood, so the Federal Supreme Court declared the appeal moot and removed it from the docket. The court fee of CHF 500 was charged to the appellant.

Berufung gegen das Urteil des Handelsgerichts des Kantons Zürich vom 12. Januar 2006.

Das Bundesgericht zieht in Erwägung:
Das Bundesgesetz über das Bundesgericht vom 17. Juni 2005 (BGG; SR 173.110) ist am 1. Januar 2007 in Kraft getreten (AS 2006 1205, 1243). Da das angefochtene Urteil des Handelsgerichts des Kantons Zürich vorher ergangen ist, richtet sich das Verfahren noch nach dem OG (Art. 132 Abs. 1 BGG).
Die Klägerin hatte gegen das mit der Berufung angefochtene Urteil des Handelsgerichts vom 12. Januar 2006 auch kantonale Nichtigkeitsbeschwerde eingelegt. Diese ist vom Kassationsgericht des Kantons Zürich mit Zirkulationsbeschluss vom 25. April 2007 gutgeheissen, das Urteil des Handelsgerichts vom 12. Januar 2006 aufgehoben und die Sache im Sinne der Erwägungen zur Neubeurteilung an die Vorinstanz zurückgewiesen worden. Der Zirkulationsbeschluss des Kassationsgerichts vom 25. April 2007 ist innerhalb der Beschwerdefrist von Art. 100 Abs. 1 BGG nicht mit Beschwerde beim Bundesgericht angefochten worden. Damit kann die beim Bundesgericht eingereichte Berufung der Klägerin als gegenstandslos geworden abgeschrieben werden. Die Gerichtsgebühr ist der Klägerin aufzuerlegen (Art. 156 Abs. 6 OG).

Demnach beschliesst das Bundesgericht:
1.
Die Berufung wird als gegenstandslos abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 500.-- wird der Klägerin auferlegt.
3.
Dieser Beschluss wird den Parteien und dem Handelsgericht des Kantons Zürich schriftlich mitgeteilt.
