In a lease dispute, the appellant failed to pay the CHF 1,000 advance on costs ordered by the Federal Supreme Court by the deadline of 8 February 2007. Applying the OG, the Court held that it could not enter into the appeal and therefore declared the appeal inadmissible. The appellant was ordered to pay court costs of CHF 300. The decision was issued in summary procedure.
Art. 150 Abs. 4 OG; non-payment of the ordered advance on costs within the prescribed time limit leads to non-entry on the appeal. The court has no discretion to examine the merits once the advance remains unpaid after the deadline. In summary procedure under Art. 36a OG, the appeal is to be dismissed without examination of the substantive complaints; the appellant bears the court costs.

dass der Kläger mit Verfügung vom 24. Januar 2007 aufgefordert wurde, spätestens bis am 8. Februar 2007 einen Kostenvorschuss von Fr. 1'000.-- einzuzahlen;
dass der Kläger den Kostenvorschuss innerhalb der angesetzten Frist nicht bezahlt hat, weshalb auf die Berufung nicht einzutreten ist (Art. 150 Abs. 4 OG);
im Verfahren nach Art. 36a OG erkannt:

Auf die Berufung wird nicht eingetreten.
2.
Die Gerichtsgebühr von Fr. 300.-- wird dem Kläger auferlegt.
3.
Dieses Urteil wird den Parteien und dem Kantonsgericht St. Gallen, III. Zivilkammer, schriftlich mitgeteilt.

No. Because the appellant did not pay the advance on costs within the set time limit, the Federal Supreme Court could not enter into the appeal.
The advance was ordered by decision of 24 January 2007 with a deadline until 8 February 2007. Non-payment triggered Article 150(4) OG, which requires non-entry.
