Resumo Omnilex

The defendant appealed a Zurich Commercial Court judgment concerning attorney fees and a fee agreement. While the federal appeal was pending, the Zurich Court of Cassation upheld the defendant’s cantonal nullity complaint, annulled the Commercial Court judgment, and remitted the case. Because that cantonal decision was not challenged before the Federal Supreme Court within the statutory period, the federal appeal no longer had an object and was struck out as moot. The court ordered the defendant to pay the federal court fee of CHF 500.

Sumário Omnilex

Art. 132 Abs. 1 BGG; Art. 156 Abs. 6 OG; an appeal against a cantonal judgment becomes moot and is struck off when, during the federal proceedings, the challenged judgment is annulled by the cantonal cassation authority and the remittal decision is not itself timely attacked. In such a constellation, the Federal Supreme Court no longer decides the merits of the original appeal. Costs are normally borne by the appellant whose appeal has become devoid of purpose (consid. 2).

Berufung gegen das Urteil des Handelsgerichts
des Kantons Zürich vom 8. Mai 2006.

Das Bundesgericht zieht in Erwägung:
Das Bundesgesetz über das Bundesgericht vom 17. Juni 2005 (BGG; SR 173.110) ist am 1. Januar 2007 in Kraft getreten (AS 2006 1205, 1243).
