X.________ filed a civil appeal to the Swiss Federal Supreme Court against a judgment of the Geneva Court of Appeal in a labor dispute. Before the Court ruled on admissibility, he withdrew the appeal by letter dated 24 December 2010. The First Civil Law Court therefore ordered the case struck from the docket under Art. 32(2) LTF and decided that no judicial fees would be charged.
Art. 32 al. 2 LTF; withdrawal of the appeal; the proceedings are removed from the roll when the appellant validly withdraws the appeal. In such a situation the Federal Supreme Court does not rule on the merits or on admissibility, but merely takes note of the withdrawal and orders the case struck from the docket; the allocation of costs may be dispensed with, as decided in the present order.
