The appellant withdrew his civil appeal to the Federal Supreme Court. The First Civil Law Court noted that the withdrawal ended the proceedings and ordered the case removed from the docket. Because the respondent had not been invited to file a response, no party costs were awarded. The appellant was ordered to pay a judicial fee of CHF 500.
Withdrawal of appeal before the Federal Supreme Court; the withdrawal terminates the proceedings and entails removal from the docket. If the respondent has not been invited to answer, no party costs are awarded; court costs are borne by the withdrawing appellant in the amount fixed by the court.
