In a civil appeal concerning a building contract dispute, the appellant informed the Federal Supreme Court that the parties had settled and withdrew the appeal. The Court therefore struck the case from the roll. It also ordered the appellant to pay CHF 2,000 in court costs and CHF 3,000 in compensation to the respondent, as no agreement on costs had been reached and the respondent had filed a response.
Art. 32 cpv. 2 LTF; withdrawal of the appeal and striking the case from the roll. Upon express withdrawal of the appeal, the Federal Supreme Court terminates the proceedings without a merits ruling. If the parties have not regulated the costs of the federal proceedings, judicial costs are allocated under Art. 65 and 66 LTF, and the opposing party who has filed a response is entitled to adequate party compensation under Art. 68 cpv. 3 LTF.

il 20 aprile 2009 dalla II Camera civile del Tribunale d'appello del Cantone Ticino.
Visto:
che con sentenza del 20 aprile 2009 la II Camera civile del Tribunale d'appello del Cantone Ticino ha confermato il giudizio pronunciato il 29 novembre 2007 dal Pretore della Giurisdizione di Locarno-Città, con il quale A.________ è stata condannata a pagare a B.________ fr. 151'703.35, oltre interessi;
che il 26 maggio 2009 A.________ è insorta dinanzi al Tribunale federale con un ricorso in materia civile volto ad ottenere la modifica della predetta sentenza nel senso dell'accoglimento dell'appello e, di conseguenza, della riduzione dell'importo a suo carico a fr. 18'705.--;
che la domanda di conferimento dell'effetto sospensivo presentata il 2 luglio 2009 è stata respinta con decreto del 9 luglio 2009;
che nella risposta dell'8 luglio 2009 B.________ ha proposto l'integrale reiezione del gravame;
considerando:
che con lettera del 1° settembre 2009 la legale della ricorrente ha comunicato l'avvenuta stipulazione di un accordo transattivo fra le parti, dichiarando nel contempo di voler di ritirare il ricorso;
che visto il ritiro del gravame la causa può venire stralciata dai ruoli, conformemente a quanto previsto dall'art. 32 cpv. 2 LTF;
che per le spese giudiziarie si rinvia all'art. 65 cpv. 1, cpv. 2 e cpv. 3 lett. b nonché all'art. 66 cpv. 2 e cpv. 3 LTF;
che, non avendo le parti concluso nessun accordo in merito alle ripetibili della sede federale, la ricorrente è tenuta a rifondere un'adeguata indennità per ripetibili all'opponente, che ha inoltrato un allegato di risposta (cfr. art. 68 cpv. 3 LTF);
per questi motivi, il Giudice Presidente decreta:

Si prende atto del ritiro del ricorso e la causa 4A_262/2009 è stralciata dai ruoli.
2.
Le spese giudiziarie di fr. 2'000.-- sono poste a carico della ricorrente, la quale rifonderà all'opponente fr. 3'000.-- per ripetibili della sede federale.
3.
Comunicazione ai patrocinatori delle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.

Whether the withdrawn civil appeal should be removed from the docket
The withdrawal of the appeal was noted and the case was struck from the roll.
Once the appellant informed the court of the settlement and expressly withdrew the appeal, the proceedings could be terminated by striking the case from the docket under Art. 32 para. 2 LTF.
Allocation of federal court costs and party compensation after withdrawal
Court costs were imposed on the appellant and the respondent was awarded party compensation.
Because the parties had not agreed on the allocation of costs and the respondent had filed a response, the appellant had to bear the judicial costs and pay adequate compensation to the respondent.
