Resumo Omnilex

In a franchising dispute, the president of the District Court of Schwyz had struck the case from the roll after a settlement. The appellant’s cantonal appeal was refused entry by the vice-president of the Cantonal Court of Schwyz for insufficient reasoning and lateness. The Federal Supreme Court held that the appellant’s filing did not satisfy the statutory reasoning requirements for a federal appeal because it did not identify any violated rights or raise substantiated constitutional complaints. The court therefore declined to enter into the appeal and imposed court costs of CHF 300 on the appellant.

Sumário Omnilex

Art. 42 Abs. 2, Art. 106 Abs. 2, Art. 108 Abs. 1 lit. b und Art. 66 Abs. 1 BGG; requirements of reasoning in an appeal to the Federal Supreme Court. A federal appeal must, by reference to the reasoning of the challenged decision, state precisely which rights are alleged to have been violated. Alleged breaches of constitutional rights are examined only if expressly raised and substantiated. Review of the application of cantonal procedural law is limited to the question of violation of federal law or constitutional rights. If these reasoning requirements are not met, the appeal is not entered into.

Urteil vom 15. Mai 2009
I. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Klett, Präsidentin,
Gerichtsschreiber Huguenin.

Parteien
X.________,
Beschwerdeführer,

gegen

Y.________,
Beschwerdegegnerin.

Gegenstand
Franchisenehmervertrag,

Beschwerde gegen die Verfügung des Kantonsgerichts Schwyz, Kantonsgerichtsvizepräsidentin, vom 18. März 2009.

In Erwägung,
dass der Präsident des Bezirksgerichts Schwyz den Prozess zwischen dem Beschwerdeführer und der Beschwerdegegnerin mit Verfügung vom 18. Dezember 2008 infolge Vergleichs als erledigt abschrieb;
dass der Beschwerdeführer diese Verfügung mit Rekurs anfocht, auf den die Vizepräsidentin des Kantonsgerichts Schwyz mit Verfügung vom 18. März 2009 wegen ungenügender Begründung und Verspätung nicht eintrat;
dass der Beschwerdeführer dem Bundesgericht eine vom 4. April 2009 datierte Eingabe einreichte, in der er erklärte, die Verfügung des Kantonsgerichts Schwyz mit Beschwerde anzufechten;
dass in einer Beschwerde an das Bundesgericht unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides dargelegt werden muss, welche Rechte der beschwerdeführenden Partei durch das kantonale Gericht verletzt worden sind (Art. 42 Abs. 2 BGG), wobei eine allfällige Verletzung der bundesrechtlichen Verfassungsrechte vom Bundesgericht nicht von Amtes wegen geprüft wird, sondern nur dann, wenn solche Rügen in der Beschwerdeschrift ausdrücklich erhoben und begründet werden (Art. 106 Abs. 2 BGG);
dass die Anwendung des kantonalen Zivilprozessrechts durch das Kantonsgericht vom Bundesgericht einzig unter dem Blickwinkel eines Verstosses gegen Bundesrecht bzw. gegen Bundesverfassungsrecht überprüft werden könnte (Art. 95 BGG; BGE 133 III 462 E. 2.3 S. 466; BGE 134 II 349 E. 3 S. 351), was aber - wie bereits festgehalten - das Vorbringen entsprechender Rügen in der Beschwerdeschrift voraussetzen würde;
dass die Eingabe des Beschwerdeführers vom 4. April 2009 diesen Begründungsanforderungen offensichtlich nicht genügt, weshalb auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass die Gerichtskosten dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt die Präsidentin:

1.
Auf die Beschwerde wird nicht eingetreten.

2.

Whether the federal appeal met the reasoning requirements for admissibility.

Decisão extraída

The filing did not sufficiently explain which rights were violated and contained no adequate constitutional complaints.

Fundamentação extraída

A federal appeal must identify the infringed rights and, for constitutional rights, expressly raise and substantiate the complaint; mere reference to the cantonal decision is insufficient.

Questão jurídica principal

Whether court costs should be imposed on the appellant.

Decisão extraída

The appellant must bear the court costs.

Fundamentação extraída

As the appeal was not entered, costs were imposed on the losing party under the Federal Supreme Court Act.
