Resumo Omnilex

X. filed a document labeled as a constitutional action against SUVA. The Federal Supreme Court held that no claim procedure under Art. 120 BGG was available, and that the submission, treated at most as a complaint, lacked a proper request and substantiated reasoning under Arts. 42 and 108 BGG. The reference to former Art. 137 OG was irrelevant because no Federal Supreme Court judgment was designated for revision. The Court therefore did not enter into the filing and exceptionally waived court costs.

Sumário Omnilex

Art. 120 BGG, Art. 42 Abs. 1 und 2 BGG, Art. 108 Abs. 1 lit. b BGG; admissibility of an allegedly constitutional action and minimum reasoning requirements of a complaint. The Federal Supreme Court may be seised by way of action only in the exhaustively enumerated cases of Art. 120 BGG; outside these cases, a filing may be considered only according to its possible procedural qualification as a complaint. A complaint must contain a request and a reasoned submission identifying the legal error alleged. Where these requirements are absent, the Court does not enter into the matter under the simplified procedure of Art. 108 BGG. A reference to the former revision provision of Art. 137 OG is ineffective absent an identified Federal Supreme Court judgment to be revised. Costs may exceptionally be waived under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 27. Juni 2007
II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Merkli, Präsident,
Gerichtsschreiber Feller.

Parteien
X.________,
Beschwerdeführer,

gegen

Schweizerische Unfallversicherungsanstalt (SUVA), Postfach 4358, 6002 Luzern.

Gegenstand
Staatshaftung,

Verfassungsklage bzw.

Lausanne, 27. Juni 2007
Im Namen der II. öffentlich-rechtlichen Abteilung
des Schweizerischen Bundesgerichts

Decisão extraída

No. The case did not fall within the exhaustive list of claim proceedings before the Federal Supreme Court.

Fundamentação extraída

Art. 120 BGG allows claims only in exhaustively listed situations; none applied here, so the filing could not be considered a claim.

Questão jurídica principal

Whether the filing met the requirements for a complaint against the Bern Administrative Court's jurisdictional decision.

Decisão extraída

No. The submission lacked both a request to set aside the decision and any substantiated reasoning showing legal error.

Fundamentação extraída

For a complaint under Arts. 42 and 108 BGG, the appellant must challenge the decision and explain the alleged legal violation. Those requirements were not met.

Questão jurídica principal

Whether revision under former Art. 137 OG could be examined.

Decisão extraída

No. No prior Federal Supreme Court judgment was identified for which revision was sought.

Fundamentação extraída

Revision presupposes a specific judgment to be revised; the filing did not refer to any such judgment.
