Resumo Omnilex

The Federal Supreme Court held that the appeal concerned tax remission and was therefore excluded from the ordinary public-law appeal. The filing could only be treated as a subsidiary constitutional complaint, but it did not meet the requirement to specifically allege and substantiate constitutional violations. Because the appeal period had already expired, giving the appellant counsel or time to file a corrected brief was futile. The Court therefore did not enter into the complaint, declared the request for suspensive effect moot, and waived court costs.

Sumário Omnilex

Art. 83 lit. m BGG, Art. 113 ff. and Art. 116 BGG; tax remission decisions are excluded from the ordinary public-law appeal and may be challenged, if at all, only by subsidiary constitutional complaint. Such a complaint must contain specific, reasoned constitutional grievances in accordance with Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG. Where the appeal period has expired, no extension for curing the defect is available; appointment of counsel cannot remedy an already time-barred defective filing. In the case of non-entry, ancillary requests such as suspensive effect become moot; court costs may be waived in view of the circumstances (consid. 1-4).

Urteil vom 4. Juni 2014

II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Zünd, Präsident,
Gerichtsschreiber Savoldelli.

Verfahrensbeteiligte
A.________,

Beschwerdeführer,

gegen

Finanz- und Kirchendirektion des Kantons Basel-Landschaft, Rheinstrasse 33b, 4410 Liestal.
2. Regierungsrat des Kantons Basel-Landschaft, Regierungsgebäude, Rathausstrasse 2, 4410 Liestal.

Gegenstand
Steuererlass,

Verfassungsbeschwerde gegen das Urteil des Kantonsgerichts Basel-Landschaft, Abteilung Verfassungs- und Verwaltungsrecht, vom 26. Februar 2014.

Mai 2014,

in Erwägung,
BGG) in Betracht fällt,

1.

Auf die Beschwerde wird nicht eingetreten.

2.

Es werden keine Gerichtskosten erhoben.

3.

Dieses Urteil wird den Verfahrensbeteiligten schriftlich mitgeteilt.

Questão jurídica principal

Whether a public-law appeal was admissible against a decision on tax remission

Decisão extraída

A public-law appeal was inadmissible because the case concerned remission of taxes within the exclusion of Art. 83 lit. m BGG.

Fundamentação extraída

The challenged judgment concerned remission of public charges, so only the subsidiary constitutional complaint could be considered.

Questão jurídica principal

Whether the subsidiary constitutional complaint was sufficiently reasoned

Decisão extraída

The complaint was not admissibly reasoned, as it failed to allege constitutional violations with the specificity required by the BGG.

Fundamentação extraída

Constitutional complaints must specifically invoke and substantiate constitutional rights; the filing did not meet Art. 42(2) and Art. 106(2) BGG.

Questão jurídica principal

Whether time should be allowed to correct the filing or appoint counsel

Decisão extraída

No extension was possible because the appeal period had expired, so appointing counsel would not cure the defect.

Fundamentação extraída

After expiry of the deadline, no extension for submitting a proper brief was available under Art. 47(1) BGG.

Questão jurídica principal

Whether the request for suspensive effect remained pending

Decisão extraída

The request became moot due to the final non-entry decision.

Fundamentação extraída

Once the appeal was not entered into, there was no pending main proceeding in which suspensive effect could operate.

Questão jurídica principal

Whether court costs should be charged

Decisão extraída

No court costs were imposed.

Fundamentação extraída

The circumstances justified waiving court costs under Art. 66(1) second sentence BGG.
