Resumo Omnilex

X. and Y. appealed to the Federal Supreme Court after the Federal Administrative Court had dismissed their challenge against the Federal Office for Migration's decision revoking refugee status and asylum. The Supreme Court held that an appeal in public law matters was excluded in asylum cases under Art. 83 lit. d ch. 1 BGG and that the filing could not be converted into a subsidiary constitutional complaint because the challenged judgment was not a cantonal final decision. The appeal was therefore manifestly inadmissible and no-entry was ordered in simplified proceedings. Court costs of CHF 300 were imposed on the appellants jointly and severally.

Sumário Omnilex

Art. 83 lit. d Ziff. 1 BGG; Art. 113 BGG; admissibility of remedies against Federal Administrative Court judgments in asylum matters. An appeal in public law matters is excluded against such decisions. Subsidiary constitutional complaint is available only against decisions of last cantonal instances; it cannot replace an inadmissible federal appeal. If inadmissibility is manifest, the Court may decline to enter in simplified proceedings under Art. 108 Abs. 1 lit. a BGG and allocate costs according to Art. 65 and Art. 66 BGG.

Urteil vom 29. September 2011
II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Zünd, Präsident,
Gerichtsschreiber Feller.

  1. Verfahrensbeteiligte
    X.________,
  2. Y.________,
    Beschwerdeführer,

gegen

Bundesamt für Migration.

Gegenstand
Aberkennung der Flüchtlingseigenschaft und Widerruf des Asyls,

Beschwerde gegen das Urteil
des Bundesverwaltungsgerichts, Abteilung IV,
vom 30. August 2011.

in Erwägung,

Whether the appeal in public law matters against the Federal Administrative Court's asylum judgment is admissible.

It is inadmissible because asylum decisions of this kind are excluded from appeal under Art. 83 lit. d ch. 1 BGG.

The challenged judgment concerns asylum; therefore the ordinary public-law appeal is excluded. The filing could also not be treated as a subsidiary constitutional complaint because the decision was not issued by a last cantonal instance, as required by Art. 113 BGG.

Questão jurídica principal

Allocation of court costs.

Decisão extraída

Court costs of CHF 300 are charged to the appellants jointly and severally, in equal shares.
