Resumo Omnilex

X. SA appealed a Geneva Administrative Court judgment that had upheld the late filing inadmissibility of its prior cantonal appeal against Geneva tax objection decisions for 2000-2003. Before the Federal Court, it sought annulment of the tax assessments, modification of the assessments, and a refund of overpaid tax. The Federal Court held that only the admissibility issue was before it, so the merits claims were خارج the scope of the dispute. It also held that the appeal failed to properly allege arbitrariness or other constitutional violations against the cantonal procedural reasoning. The appeal was therefore manifestly inadmissible and court costs of CHF 5,000 were imposed on the appellant.

Sumário Omnilex

Art. 107 al. 1, 106 al. 2 and 108 al. 1 let. a et b LTF; scope of review and requirements of reasoning in a public-law appeal. The object of proceedings before the Federal Court is determined by the challenged decision and the conclusions of the parties; a party may not enlarge the dispute by seeking relief on matters not decided below. Where the appeal concerns only the inadmissibility of a prior cantonal appeal, the Federal Court examines solely that procedural question and not the underlying merits. Complaints concerning the application of cantonal law are admissible only insofar as they are specifically framed as constitutional grievances, in particular arbitrariness, and reasoned in a manner meeting Art. 106 al. 2 LTF. Failing such reasoning, the appeal is manifestly inadmissible and may be dealt with in simplified procedure under Art. 108 LTF.

Objet

106 al. 2 LTF, ATF 136 I 65 consid. 1.3.1 p. 68).

Whether the Federal Court could examine the merits of the tax assessments despite the appealed judgment only concerning inadmissibility for lateness.

Decisão extraída

No; the dispute before the Federal Court was limited to the admissibility of the 4 June 2008 appeal, so merits requests were outside the scope of the case.

Fundamentação extraída

The object of the Federal Court proceedings is determined by the challenged decision and the parties' conclusions. Since the cantonal judgment only confirmed inadmissibility of the earlier appeal, substantive requests for annulment, modification, and refund went beyond the dispute.

Questão jurídica principal

Whether the appeal sufficiently alleged arbitrary application of cantonal procedural law or other constitutional violations against the inadmissibility ruling.

Decisão extraída

No; the complaint did not meet the required reasoning standard.

Fundamentação extraída

A public-law appeal may invoke cantonal law only through constitutional grounds such as arbitrariness, and such a grievance must be specifically reasoned under Art. 106(2) LTF. The appellant did not challenge the cantonal procedural reasoning with a proper arbitrariness argument.

Questão jurídica principal

Overall admissibility of the federal appeal

Decisão extraída

The appeal was manifestly inadmissible and decided under the simplified procedure.

Fundamentação extraída

Because the merits submissions were inadmissible and the constitutional reasoning requirement was not met, the appeal fell under Art. 108(1)(a) and (b) LTF.
