Resumo Omnilex

The complainant filed a constitutional complaint against the federal Passive Smoking Protection Act, arguing that it violated fundamental rights and should be removed from circulation. The Federal Supreme Court held that federal statutes and Federal Council ordinances cannot be directly challenged before it by public law appeal, constitutional complaint, or any other remedy. The filing was therefore manifestly inadmissible and no entry was made in simplified proceedings. Court costs of CHF 500 were imposed on the complainant.

Sumário Omnilex

Art. 113 BGG, Art. 82 BGG; direct review of federal statutes and Federal Council ordinances before the Federal Supreme Court is excluded. Constitutional complaint lies only against decisions of last cantonal instances where no appeal under Art. 72-89 BGG is available. Federal acts and federal ordinances are not themselves amenable to public law appeal, constitutional complaint, or any other federal remedy; a manifestly inadmissible filing may be dealt with under Art. 108 BGG. Costs follow the outcome pursuant to Art. 65 and Art. 66 Abs. 1 BGG.

Urteil vom 27. Mai 2010
II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Zünd, Präsident,
Gerichtsschreiber Feller.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Schweizerische Eidgenossenschaft, Bundeskanzlei.

Gegenstand
Passivrauchen,

in Erwägung,

Lausanne, 27. Mai 2010
