Where the challenged cantonal decision loses its practical significance during the Federal Court proceedings and the parties concur that the appeal has become devoid of object, the Court strikes the case from the docket. In deciding costs, it takes into account the situation existing before the event causing mootness. If the appellant could in good faith assume that the cantonal decision definitively settled the matter, judicial fees may be waived and party compensation awarded, even though the appeal is no longer examined on the merits (consid. 1).

recours de droit public contre l'arrêt du Tribunal d'accusation du 24 octobre 2002.

Considérant:
Que R.________, avocat à Lausanne, a été désigné en qualité d'avocat d'office de la victime dans une cause pénale;
Que le prévenu a recouru contre le prononcé du Juge d'instruction ordonnant son renvoi devant le Tribunal correctionnel;
Que le Tribunal d'accusation du Tribunal cantonal vaudois, statuant le 24 octobre 2002, a admis le recours et mis fin à la cause par non-lieu;
Qu'il a taxé les frais de l'enquête pénale à 5'391 fr.75;
Qu'il a également taxé à 210 fr. l'indemnité due à Me R.________ pour ses prestations en faveur de la victime;
Que Me R.________ a déféré ce prononcé au Tribunal fédéral, par la voie du recours de droit public;
Qu'il se plaignait d'une rétribution arbitrairement basse;
Que le Tribunal d'accusation indique, dans ses observations, que l'indemnité de 210 fr. se rapporte exclusivement à la procédure de recours contre l'ordonnance de renvoi, et que l'indemnité afférente aux prestations fournies auparavant sera taxée dans une décision ultérieure du Juge d'instruction;
Que le recours de droit public est ainsi devenu sans objet, conformément aux opinions concordantes du recourant, du Tribunal d'accusation et du Ministère public;
Qu'en pareille situation, le Tribunal fédéral raye la cause du rôle et statue sur les frais et dépens en tenant compte de l'état de choses existant avant l'événement mettant fin à la procédure (art. 40 OJ, 72 PCF; ATF 110 Ia 140);
Que Me R.________ pouvait de bonne foi se croire fondé à recourir, compte tenu que l'arrêt du Tribunal d'accusation ne comportait aucune clause de renvoi de l'affaire au Juge d'instruction;
Que celle-ci paraissait, au contraire, entièrement terminée, y compris au sujet des frais et indemnités;
Que dans ces conditions, il y a lieu de ne pas percevoir l'émolument judiciaire et d'allouer des dépens à l'avocat recourant (cf. ATF 125 II 518 consid. 5b p. 519).

Par ces motifs, le Tribunal fédéral prononce:

La cause est rayée du rôle.
2.
Il n'est pas perçu d'émolument judiciaire.
3.
Le canton de Vaud versera une indemnité de 500 fr. au recourant à titre de dépens.
4.
La présente décision est communiquée en copie au recourant, au Procureur général et au Tribunal d'accusation du Tribunal cantonal du canton de Vaud.
