Resumo Omnilex

X. challenged the Cantonal Administrative Court’s judgment concerning withdrawal of his driver’s license. The Federal Supreme Court held that the appeal was only formulated in general, appellative terms and failed to engage specifically with the reasoning of the cantonal decision. As the appeal did not satisfy the statutory reasoning requirements, the court did not enter into it under the simplified procedure. Given the obvious defect, no court costs were imposed.

Sumário Omnilex

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; requirements for substantiation of an appeal to the Federal Supreme Court. An appeal must, in a reasoned manner, engage with the decisive considerations of the challenged decision and show, with reference to the applicable law, why that decision is unlawful; mere appellative criticism or schematic assertions are insufficient (consid. 1). Where this defect is obvious, the Court may decide in simplified procedure under Art. 108 Abs. 1 BGG and may waive costs under Art. 66 Abs. 1 BGG.

Urteil vom 4. April 2011
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Fonjallaz, Präsident,
Gerichtsschreiber Bopp.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Glarus, Abteilung Administrativmassnahmen, Postgasse 29, Postfach, 8750 Glarus.

Gegenstand
Entzug des Führerausweises,

Beschwerde gegen das Urteil vom 2. März 2011 des Verwaltungsgerichts des Kantons Glarus, I. Kammer.

In Erwägung,
dass X.________ gegen den am 2. März 2011 betreffend Führerausweisentzug ergangenen Entscheid der I. Kammer des Verwaltungsgerichts des Kantons Glarus der Sache nach Beschwerde in öffentlich-rechtlichen Angelegenheiten ans Bundesgericht führt;

dass das Bundesgericht davon abgesehen hat, Vernehmlassungen einzuholen;

dass der Beschwerdeführer den genannten, ausführlich begründeten Entscheid auf ganz allgemeine, appellatorische Weise stichwortartig beanstandet, dabei aber nicht im Einzelnen darlegt, inwiefern die ihm zugrunde liegenden Erwägungen bzw. der Entscheid selber im Ergebnis rechts- bzw. verfassungswidrig sein sollen;

dass die Beschwerde daher den gesetzlichen Formerfordernissen (Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG; s. in diesem Zusammenhang BGE 136 I 49 E. 1.4.1 S. 53, 65 E. 1.3.1 S. 68 mit Hinweisen) nicht zu genügen vermag;

dass demgemäss schon aus diesem Grund auf die Beschwerde nicht einzutreten ist;

dass der genannte Mangel offensichtlich ist, weshalb über die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 BGG entschieden werden kann;

dass es sich bei den gegebenen Verhältnissen rechtfertigt, für das vorliegende Verfahren keine Kosten zu erheben (Art. 66 Abs. 1 BGG);

wird erkannt:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft des Kantons Glarus, Abteilung Administrativmassnahmen, dem Verwaltungsgericht des Kantons Glarus, I. Kammer, und dem Bundesamt für Strassen, Sekretariat Administrativmassnahmen, schriftlich mitgeteilt.

Questão jurídica principal

Whether the appeal met the Federal Supreme Court’s reasoning requirements under Art. 42(2) and Art. 106(2) BGG

Decisão extraída

No. The appeal did not explain in a specific way why the lower court’s reasoning or result was unlawful or unconstitutional.

Fundamentação extraída

The submissions were merely general and appellative; this does not satisfy the requirement to address the challenged reasoning in a concrete manner.

Questão jurídica principal

Whether costs should be charged for the Federal Supreme Court proceedings

Decisão extraída

No costs were imposed in view of the circumstances.

Fundamentação extraída

Because the deficiency in the appeal was obvious, the court decided the case summarily and waived court costs under Art. 66(1) BGG.
