Resumo Omnilex

X. challenged the Basel-Stadt Appellationsgericht’s refusal to grant access to criminal case files after the underlying case had become final. The Federal Supreme Court held that the complaint failed to satisfy the reasoning requirements of Art. 42(2) BGG, as no admissible ground of appeal was articulated. It therefore did not enter into the complaint in simplified procedure under Art. 108(1)(b) BGG. The request for legal aid was denied because the appeal had no prospect of success, and no court costs were imposed.

Sumário Omnilex

Art. 42 Abs. 2 BGG; Art. 108 Abs. 1 lit. b BGG; ungenügende Beschwerdebegründung and summary non-entry; a federal complaint must, in concise form, specify the legal grounds and explain how the contested decision infringes law. If no admissible ground is raised and the alleged error is not substantiated, the Federal Supreme Court may decline to enter in simplified procedure where the deficiency is manifest. Art. 64 BGG: legal aid is refused if the proceeding lacks prospects of success. Art. 66 Abs. 1 BGG permits waiver of court costs despite non-entry.

Urteil vom 23. September 2010
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Pfäffli.

Verfahrensbeteiligte
X.________, Beschwerdeführer,

gegen

Appellationsgericht des Kantons Basel-Stadt, Statthalterin, Bäumleingasse 1, 4051 Basel.

Gegenstand
Akteneinsicht,

Beschwerde gegen die Verfügung vom 13. August 2010 des Appellationsgerichts des Kantons Basel-Stadt, Statthalterin.
Erwägungen:

1.
