Resumo Omnilex

The Federal Supreme Court dismissed the complaint against the Basel-Landschaft criminal court president’s order that retroactively extended the applicant’s preventive detention until 24 June 2009. It held that, after its earlier remittal for a reasoned decision meeting Art. 112(1)(b) BGG, the new order did not show any violation of the prohibition of retroactivity or of ne bis in idem. Because the complaint was manifestly unfounded and did not adequately satisfy the reasoning requirements, the Court refused free legal aid and charged court costs of CHF 500 to the applicant.

Sumário Omnilex

Art. 42 Abs. 2, Art. 64 Abs. 1 und 2, Art. 66 Abs. 1 BGG; complaint against a remittal-compliant detention order and alleged violation of retroactivity/ne bis in idem. A complaint must substantiate, in a manner meeting Art. 42(2) BGG, why the challenged decision is unlawful. Where the cantonal authority, after remittal, renders a new decision on the same detention matter, a violation of the prohibition of retroactivity or of ne bis in idem is not established merely by the renewed adjudication; specific unlawful duplication or temporal impermissibility must be shown. Free legal aid is refused when the matter is devoid of prospects of success; costs follow the outcome.

Urteil vom 2. Juli 2009
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Bundesrichter Fonjallaz, Eusebio,
Gerichtsschreiber Pfäffli.

Parteien
X.________, Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Basel-Landschaft, Bahnhofplatz 3A, 4410 Liestal.

Gegenstand
Haftverlängerung,

Beschwerde gegen die Verfügung vom 22. Juni 2009
des Strafgerichts Basel-Landschaft, Präsidentin.
In Erwägung,
dass die Präsidentin des Strafgerichts Basel-Landschaft mit Verfügung vom 27. Mai 2009 die am 27. März 2009 gegen X.________ verlängerte Sicherheitshaft um weitere 4 Wochen, d.h. bis 24. Juni 2009, verlängert hat;
dass das Bundesgericht mit Urteil vom 9. Juni 2009 (Verfahren 1B_157/2009) die Verfügung der Präsidentin des Strafgerichts Basel-Landschaft vom 27. Mai 2009 aufgehoben und die Sache zum neuen Entscheid an diese zurückgewiesen hat, damit diese einen Entscheid treffe, der den Anforderungen von Art. 112 Abs. 1 lit. b BGG genügt;
dass die Präsidentin des Strafgerichts Basel-Landschaft mit Verfügung vom 22. Juni 2009 die am 27. März 2009 verlängerte Sicherheitshaft "rückwirkend per 27. Mai 2009 bis 24. Juni 2009 verlängert" hat;
dass X.________ gegen diese Verfügung mit Eingabe vom 24. Juni 2009 Beschwerde in Strafsachen beim Bundesgericht eingereicht und eine Verletzung des Rückwirkungsverbots und des Grundsatzes ne bis in idem geltend gemacht hat;
dass die Präsidentin des Strafgerichts Basel-Landschaft mit Verfügung vom 22. Juni 2009 in Nachachtung des bundesgerichtlichen Urteils nochmals über die in der aufgehobenen Verfügung vom 27. Mai 2009 verlängerte Sicherheitshaft befunden hat;
dass nicht ersichtlich ist, inwiefern sie dabei das Rückwirkungsverbot oder den Grundsatz ne bis in idem verletzt haben sollte;
dass die Beschwerde, soweit sie überhaupt den Begründungsanforderungen von Art. 42 Abs. 2 BGG zu genügen vermag, als offensichtlich unbegründet abzuweisen ist;
dass angesichts der Aussichtslosigkeit des Verfahrens dem Gesuch um unentgeltliche Rechtspflege nicht zu entsprechen ist (Art. 64 Abs. 1 und 2 BGG);
dass die Gerichtskosten dem Ausgang des Verfahrens entsprechend dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt das Bundesgericht:

1.

Whether the retroactive extension of preventive detention violated the prohibition of retroactivity or ne bis in idem

Decisão extraída

No such violation is apparent; the challenged order merely decided again on the detention previously extended and did not breach either principle.

Fundamentação extraída

The president of the cantonal criminal court ruled again pursuant to the Federal Supreme Court's remittal. The complaint did not show how the new order would infringe the retroactivity ban or ne bis in idem.

Questão jurídica principal

Whether the complaint satisfied the Federal Supreme Court's reasoning requirements

Decisão extraída

Only insofar as the complaint complied with Art. 42(2) BGG could it be considered; otherwise it was not examined.

Fundamentação extraída

The filing did not adequately address the reasoning requirements, so the Court limited review accordingly.

Questão jurídica principal

Whether free legal aid should be granted

Decisão extraída

Denied because the proceedings had no prospect of success.

Fundamentação extraída

Given the manifest lack of merit, the request for legal aid failed under Art. 64 BGG.

Questão jurídica principal

Who bears the court costs

Decisão extraída

The applicant must bear the costs.

Fundamentação extraída

Costs follow the outcome of the proceedings under Art. 66(1) BGG.
