In a criminal venue dispute between the public prosecutors of Basel-Stadt and Baselland, the Anklagekammer held that it determines jurisdiction independently of the cantonal authorities' view. For venue under Art. 350 no. 1 SCC, it must provisionally assess the conduct alleged in the file and the penalty threatened by that conduct. The decisive point is not what the accused ultimately committed, but what is alleged and can be considered on the record at this stage. The chamber stressed that it performs only a preliminary review; the substantive fulfillment of any offense remains for the trial court.

Aus den Erwägungen:
Ob jemand im Sinne von Art. 350 Ziff. 1 StGB verfolgt sei, beurteilt die Anklagekammer unabhängig von der Stellungnahme der kantonalen Behörden (BGE 85 IV 247 Erw. 2 und dort angeführte Urteile). Frei ist die Anklagekammer auch in bezug auf die Frage, wie die Gegenstand der Untersuchung bildenden Tatbestände einstweilen zu würdigen seien. Ein Kanton soll den Gerichtsstand nicht dadurch beeinflussen können, dass er die von ihm in Untersuchung gezogenen Handlungen rechtlich unzutreffend beurteilt. Indem das Gesetz in Art. 350 Ziff. 1 den Gerichtsstand von der Schwere der angedrohten Strafe abhängig macht, mutet es der Anklagekammer zu, die dem Beschuldigten zur Last gelegten Handlungen vorläufig zu würdigen (BGE 71 IV 166). Ergibt sich dabei, dass eine Handlung einer schwereren Strafandrohung unterliegen könnte als die kantonale Behörde annimmt, so ist dies bei der Anwendung des Art. 350 Ziff. 1 StGB zu berücksichtigen (vgl. BGE 75 IV 138 Erw. 2).
Freilich ist in diesem Stadium des Verfahrens die Strafsache meistens noch nicht näher abgeklärt. Es ist deshalb oft schwierig zu sagen, welche Handlungen der Beschuldigte überhaupt verübt und welche Strafbestimmungen er allenfalls erfüllt habe. Der Gerichtsstand bestimmt sich indes nicht nach dem, was der Täter begangen hat, sondern nach dem Tatbestand, der ihm vorgeworfen wird, d.h. auf Grund der Aktenlage überhaupt in Frage kommt (BGE 71 IV 167, BGE 74 IV 125, BGE 87 IV 44, BGE 88 IV 44). Die Anklagekammer hat zudem lediglich eine Vorprüfung vorzunehmen. Ob ein Straftatbestand wirklich erfüllt und der Beschuldigte deswegen weiterzuverfolgen, dem Richter zu überweisen und zu verurteilen sei, ist im nachfolgenden Strafverfahren zu prüfen. Der Entscheid der Anklagekammer ist für die kantonalen Behörden nur hinsichtlich des Gerichtsstandes verbindlich.
